12-7-100 - Definitions.¶
As used in this chapter:
Air-gap separation shall mean a physical break between a supply pipe and a receiving vessel which shall be at least double the diameter of the supply pipe, measured vertically above the top rim of the vessel, and in no case less than one inch.
Approved backflow preventer shall mean a device installed to protect the potable water supply from contamination by recycled water. The device must conform to the requirements of State of California, Health and Safety Code, Title 17, and Town of Windsor Design and Construction Standards. Makes and models of acceptable devices must appear on the State list of currently approved devices which is periodically published by the California Department of Health Services.
Connection fee shall mean a charge imposed by the Town for providing recycled water service, including construction and/or installation of off-site and on-site facilities.
Cross-connection shall mean any unprotected connection between any part of a water system used or intended to supply potable water and any service or system containing recycled or other water or substance that is not safe, wholesome and potable for human consumption.
Cross-connection Specialist shall mean an American Water Works Association or University of Southern California certified cross-connection specialist.
Department shall mean the Town's Department of Public Works.
Nonpotable water shall mean water that has not been treated for human consumption in conformance with the drinking water standards referred to in the definition of potable water.
Off-site facilities shall mean facilities under the control of the Town including, but not limited to, recycled water pipelines, reservoirs, pumping stations, manholes, valves, connections, supply interties, treatment facilities, and other appurtenances and property. For recycled water service, off-site facilities shall be those upstream of the point of connection with the user's on-site facilities located and starting at the downstream end of the meter tailpiece.
On-site facilities shall mean facilities under the control of an applicant, owner or user. For recycled water service, the on-site facilities shall be those downstream of the recycled service connection, which shall normally be the downstream end of the meter tailpiece.
Potable water means that water that does not contain objectionable pollution, contamination, minerals or infective agents and is considered satisfactory for domestic consumption, and conforms to the latest edition of the United States Public Health Service Drinking Water Standards, the California Safe Drinking Water Act, and any other applicable standards.
Recycled water shall mean disinfected tertiary recycled water as defined in Chapter 3 of Division 4 of Title 22 of the California Code of Regulations as may be amended from time to time.
Recycled water facilities shall mean facilities used in and by the Town for the storage, pumping and conveyance of recycled water. Recycled water facilities are intended to provide recycled water for uses such as landscape irrigation, agricultural irrigation, and construction or industrial process water, as set forth in the Recycling Criteria.
Recycled water service connection shall mean the point of connection of the user's recycled water line with the recycled water service line of the town, which shall normally be the downstream end of the recycled water meter connection.
Recycled water service line shall mean the Town's facility between its recycled water distribution system and the recycled water service connection.
Recycled water mains shall mean recycled water lines and appurtenances purchased or constructed and owned by the Town or which the Town requires an applicant, owner or user to construct but which are owned by the Town. The Town shall determine what facilities are recycled water mains from time to time. The Town's determination in regard to these matters shall be final and conclusive.
Recycled water service area shall mean the property, or portion of property, on which recycled water is available from the Town and is required for irrigation in lieu of potable water.
Recycling Criteria shall mean the regulations promulgated pursuant to Water Code Section 13521, and set forth in Chapter 3 of Division 4 of Title 22 of the California Code of Regulations Sections 60301 et seq., as may be amended from time to time.
User shall mean any user of recycled water provided by the Town.
User's recycled water supervisor shall mean a qualified person, designated by a non-residential recycled water user and approved by the Town, who shall be knowledgeable in the construction and operation of on-site facilities and irrigation systems, and in the application of the applicable guidelines, criteria, standards, rules and regulations for use of recycled water.

12-7-105 - Policy¶
a. Recycled water shall be used for residential and non-residential irrigation within the Town's recycled water service area, whenever feasible and consistent with legal requirements, preservation of public health, safety and welfare, and the environment. This requirement is subject to any limitations set forth in this Chapter or otherwise established by local, state or federal law. Use of potable' water for irrigation when recycled water use is technically and economically feasible, is an unreasonable use of water as stated in California Water Code Section 13550.
b. Where the use of recycled water is feasible, appropriate and acceptable to all applicable regulatory agencies for the purposes of landscape irrigation, or other uses permitted by the controlling regulatory agencies, it is the policy of the Town to require the applicant, owner or, user to use recycled water in lieu of potable water. The Town Manager or his/her designee shall determine in his or her discretion whether it is feasible or desirable to furnish an applicant, owner or user with potable water for non-residential irrigation either on a permanent basis or on an interim basis. Determinations on the specific uses to be allowed shall be in accordance with the requirements of all applicable regulatory agencies. Each such usage of recycled water shall, in addition, be subject to the availability of recycled water as well as recycled water facilities and the feasibility of making such facilities available now or in the foreseeable future.
c. The use of recycled water shall be limited to those uses permitted by federal and state law, and to those uses approved by the Town Manager or his/her designee for the recycled water service area. All uses of recycled water shall conform to the requirements of the Town's NPDES Waste Discharge Permit, and all other applicable regulatory requirements, including but not limited to the Recycling Criteria.
d. In development projects within the Town's potential recycled water service area, the Town may require that irrigation systems be designed and installed at the property owner's expense and in accordance with the requirements of this Chapter, so that the conversion to recycled water use may be initiated when recycled water service becomes available. At the discretion of the Town Manager or his/her designee, the irrigation system may be connected to a separate potable water irrigation service with an approved backflow detector in the interim until the recycled water service is available.
e. The Town Manager or his/her designee shall establish and may vary conditions of pressure and delivery of recycled water.

12-7-110 - Rules and Regulations.¶
In addition to the Rules and Regulations set forth in this Code, as may be amended from time to time, the Town Council may by resolution establish and change rules and regulations relating to fees and charges, personnel matters and any other matter not regulated herein.
