Procedure to amend this title or any of the provisions thereof may be initiated by the filing of a written petition of one or more property owners or by action of the city council or the planning commission. [Ord. 632-91 § 5.01, 10-22-91].

(1) Each property owner petition shall explain fully the amendment and/or change of zoning requested and shall be accompanied by maps or drawings as may be required for property consideration of the request.

(2) Each property owner petition shall be accompanied by a filing fee as established by city council resolution. [Ord. 632-91 § 5.02, 1022-91].

(1) The planning commission shall hold public hearings as required by law on any proposed amendments and shall give notice thereof by at least one publication in a newspaper of general circulation within the city at least 10 days prior to such hearings.

(2) In case the proposed amendment affects the permitted uses of the property, the city shall give notice of the hearing by mail to all persons or parties owning property within 300 feet of the subject property as shown on the last equalized assessment roll. Notice of the hearing shall also be delivered by mail to any local agency expected to deliver water, sewer, roads, schools or other essential services to the subject property. Following the aforesaid hearings, the planning commission shall submit a report of its findings and a summary of hearings, together with its recommendations with respect to the proposed amendment to the city council. [Ord. 632-91 § 5.04, 10-22-91].

Upon receipt of such report from the planning commission, the city council shall set the matter for public hearing and notice according to guidelines set forth in state law. If the planning commission has recommended against the amendment, the city council shall not be required to hold a public hearing or to take any further action unless an interested party shall request such a hearing by filing a written request with the city manager no later than five days after the planning commission files its recommendation with the city council. The city council may approve, modify or disapprove the recommendations of the planning commission. Any modification of the recommendations of the planning commission shall first be referred back to the planning commission for report and recommendation, but the planning commission is not required to hold a public hearing for this review. Failure of the planning commission to report back to the city council within 40 days after the referral shall be deemed an approval of the proposed modification. [Ord. 632-91 § 5.06, 1022-91].
