Willits Municipal Code Ch. 1.01 Code Adoption

The city council finds that:

A. California Government Code Sections 50022.1 through 50022.10, inclusive, permit cities to codify and publish their permanent and general ordinances in convenient and usable form;

B. The Book Publishing Company of Seattle, Washington, has compiled, edited and published a codification of the permanent and general ordinances of the city;

C. There have been filed and there are now on file in the office of the city clerk, for public inspection, three copies of the document entitled "Willits Municipal Code," and three copies of any secondary codes therein mentioned and previously adopted by ordinance;

D. Notice of public hearing on the proposed adoption of the Willits Municipal Code has been given as required by Government Code Sections 6066 and 50022.3, and has been published as required by law in the Willits News, a newspaper of general circulation printed and published within the city.

Pursuant to the provisions of California Government Code Sections 50022.1 and 50022.10, inclusive, there is adopted the Willits Municipal Code, as published by the Book Publishing Company of Seattle, Washington.

The code adopted by the ordinance codified in this chapter shall be known as the Willits Municipal Code, and it shall be sufficient to refer to said code as the Willits Municipal Code in any prosecution for the violation of any provision thereof or in any proceeding at law or in equity. It shall be sufficient to designate any ordinances adding to, amending, correcting or repealing all or any part thereof as an addition to, amendment to, correction or repeal of, the Willits Municipal Code.

The last ordinance included in the Willits Municipal Code, as adopted by the ordinance codified in this chapter is Ordinance No. 78-10. Ordinances enacted after Ordinance No. 78-10 remain in effect and are the law of the city, and will be made a part of the Willits Municipal Code, where appropriate, in the first annual supplement thereto.

Whenever a reference is made to the Willits Municipal Code or to any part thereof, that reference shall apply to all amendments, corrections and additions now or hereafter made.

Title, chapter and section headings contained in the Willits Municipal Code shall not be deemed to govern, limit, modify or in any manner affect the scope, meaning or intent of the provisions of any title, chapter or section thereof.

(Ord. 80-1 §6).

The provisions of the Willits Municipal Code shall not in any manner affect matters of records which refer to, or are otherwise connected with ordinances which are therein specifically designated by number or otherwise and which are included within the code, but such reference shall be construed to apply to the corresponding provisions contained within the code.

Neither the adoption of the Willits Municipal Code nor the repeal or amendment thereby of any ordinance of part of any ordinance of the city shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date of the code, nor be construed as a waiver of any license, fee, or penalty at said effective date due and unpaid under such ordinances, nor be construed as affecting any of the provisions of such ordinances relating to the collection of any such license, fee, or penalty, or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof required to be posted, filed or deposited pursuant to any ordinance; and all rights and obligations arising therefrom shall continue in full force and effect.

The ordinance codified in this chapter shall become effective thirty days after its final passage, and the Willits Municipal Code shall become effective on the same date. The city clerk is directed to publish the ordinance codified in this chapter in the Willits News, a newspaper of general circulation printed and published within the city, within fifteen days after its final passage.
