3.36.010 - Definitions.

The following words and expressions when used in this chapter shall for the purpose of this chapter have the meanings respectively ascribed to them, as follows:

A. "Infrastructure" means general fund capital improvements including streets, sidewalks, bridges, bike paths, and related right-of-way features, stormwater and drainage systems, public buildings such as libraries, recreational and community centers, public safety facilities such as police, fire and lifeguard stations and park facilities, as well as maintenance equipment, vehicles and other equipment used to maintain said capital improvements. Software and other technology with a useful life in excess of five years is also included in the definition of "infrastructure."

B. "Infrastructure revenues" means revenue dedicated to the infrastructure fund pursuant to this chapter.

There is hereby established within the City of Williams the "infrastructure fund," which shall be a separate fund contained within the city's general fund.

3.36.030 - Purpose.

The infrastructure fund shall be used to fund the construction, reconstruction, rehabilitation, repair, and maintenance of infrastructure, including associated financing and personnel costs.

3.36.040 - Transfers into and from the infrastructure fund.

A. Deposit of funds. The infrastructure fund shall be funded by the deposit/transfer of revenue from the general fund to the infrastructure fund in an amount equal to or greater than one hundred thousand dollars each year, commencing with fiscal year 2019-2020.

B. Discretionary deposits permissible. Nothing in this chapter shall prohibit the city council, as part of the budgeting process, from contributing additional revenues to the infrastructure fund, as determined in the city council's sound legislative discretion.

C. Suspension. The mayor may request the suspension of the requirements of this chapter for one fiscal year or for the remainder of a fiscal year. After at least one public hearing on the request for suspension, the city council may approve a one-year suspension by a vote of two-thirds of the city council.

D. Expenditure of funds. Infrastructure revenues shall be used exclusively for the construction, reconstruction, rehabilitation, repair and maintenance of infrastructure, including all costs associated with construction, reconstruction, rehabilitation, repair and maintenance of infrastructure. Personnel costs associated with such uses are also permitted. Infrastructure revenues may not be used to fund operations, such as utility costs, janitorial services, waste management and upkeep of grounds.
