§ 1.16.010. Violation—Misdemeanor or infraction.¶
Except as otherwise provided, every person who violates any provision or who fails to comply with any of the requirements of this code or any other ordinance of the city is guilty of a misdemeanor unless the offense is specifically classified in the code or by state law as an infraction, or the city prosecutor reduces the charge to an infraction in the interests of justice, in which case the person shall be guilty of an infraction. Each such person shall be deemed guilty of a separate offense for each and every day or any portion thereof during which any violation of any provision of the code or ordinance is committed, continued or permitted by such person and shall be deemed punishable therefor as provided in this code.

§ 1.16.020. Violation—Misdemeanor and infraction penalties.¶
A. Violation of this code or any other ordinance of the city, unless otherwise provided in the code provision or such ordinance, is punishable by a fine not to exceed $1,000 or by imprisonment in the county jail for not to exceed six months, or by both such fine and imprisonment.
B. Except as otherwise provided by this code or any ordinance of this city, a violation of any provision of the code or ordinance that is defined or charged as an infraction is punishable by:
A fine of not more than $100 for a first violation;
A fine of not more than $200 for a second violation of the same provision of code or ordinance within one year;
A fine of not more than $500 for each additional violation of the same provision of code or ordinance within one year;
A fourth violation of the same provision of code or ordinance, regardless of time of occurrence, shall constitute a misdemeanor and shall be punishable as provided in subsection A of this section.

§ 1.16.030. Civil remedies available.¶
In addition to the penalties provided in this chapter, the violation of any provision of this code or of any other ordinance of the city shall constitute a nuisance and may be abated by the city pursuant to Chapter 8.08, through civil process by means of a restraining order, preliminary or permanent injunction, or in any other manner provided by law. The city also may pursue any other remedy provided by law.
