§ 8.32.010. Purpose of chapter.

The purpose of this chapter is to provide for the care, restitution, sale or destruction of unclaimed property in the possession of the police department.

§ 8.32.020. Length of time property held by police.

Unclaimed property shall be held by the police department for a period of at least three months.

§ 8.32.030. Sale of property at public auction.

After holding property for the period described in Section 8.32.020, such property may be sold at public auction to the highest bidder, and the proceeds therefrom shall be deposited in the city's general fund.

§ 8.32.040. Notice of auction.

Notice of such sale shall be given by the police department, at least five days before the time fixed therefor, by publication once in a newspaper of general circulation published in the county.

§ 8.32.050. Restoration of property to owner prior to sale.

Upon demand prior to sale, accompanied by such proof of ownership as the police department may require, the police department shall restore such property to the owner.

§ 8.32.060. Sales receipt to be valid title.

The receipt for the sale price signed by the police department shall be valid title to the purchaser of property so sold.

§ 8.32.070. Disposition of unsold property.

Property remaining unsold in the possession of the police department after being offered at public auction may be destroyed or otherwise disposed of by the police department.

§ 8.32.080. Transfer of property to police purchasing agent for sale at public auction…

As an alternative to the disposition of unclaimed property pursuant to Sections 8.32.030 through 8.32.070, after holding property for the period prescribed in Section 8.32.020, the police department may transfer such property to the police purchasing agent. If property is transferred to the police purchasing agent pursuant to this section, such property shall not be redeemable by the owner or other person entitled to possession. If the police purchasing agent determines that any such property transferred to the police department is needed for a public use, such property may be retained by the city and need not be sold otherwise. The police purchasing agent may dispose of its property in the manner described in Section 8.32.030. For purposes of this chapter, the chief of police shall be designated as the police purchasing agent.
