5.24.010 - Definitions.

The following definitions shall apply to this chapter:

"Applicant" is the person who applies for a short-term rental permit. The applicant shall be the record owner of the property for which the permit is to be issued.

"City council" is the city council of the City of Weed.

"City manager" is the city manager or city administrator, or designee, of the City of Weed.

"Hosted homestay" is an owner-occupied single-family dwelling unit where, for compensation, individual daily or overnight accommodations for the use and occupation of one or more rooms are provided for a period of less than thirty days.

"Permit" is a license or other formal approval to allow a property owner to operate a short-term rental.

"Person" is an individual, trustee of a trust, or a corporation or other business entity, except that only the manager of a limited liability company may represent it.

"Planning commission" is the planning commission of the City of Weed.

"Short-term rental" is either a "hosted homestay" or a "vacation rental", as those terms are defined in this chapter, and shall not include a hotel or motel which are licensed and lawfully operating within an allowable zoning district and/or upon the issuance of a use permit.

"Vacation rental" is an entire dwelling unit where, for compensation, overnight accommodations for the use and occupation of the unit are provided for a period of less than thirty days during which period the owner of the unit does not occupy the dwelling unit during the term of the rental.

5.24.020 - Short-term rental requirements.

No person shall offer to rent, or rent, to others, a short-term rental on any parcel in any zoning district without first obtaining a permit as required by this section. The provisions of this chapter shall apply to all existing and future short-term rentals. Existing short-term rentals shall either apply for authority to operate within sixty days of the effective date of this chapter.

5.24.030 - Permitting process.

A. Hosted Homestay. Hosted homestays are allowed within all zoning districts upon the application and issuance of a permit therefor by the city clerk, said application shall be in a form approved by the city manager and include proof of ownership and written affirmation by the applying property owners that they understand and agree to the comply with the requirements of this chapter. The city manager may not impose any additional conditions except as may be authorized or required by this Code.

B. Vacation Rental. Vacation rentals are allowed in all zoning districts only upon the application and issuance of a conditional use permit by the planning commission, according to the criteria set forth in Chapter 18.32 of this Code. The city manager and planning commission may, in their discretion, designate the information to be included in the application and the conditions upon which any such short-term rental use permit may be issued, denied, suspended, renewed, reinstated, or revoked.

C. Application Fee. To the extent necessary to recover its costs of administration and enforcement of this chapter, the city council may, by resolution, specify the fees to be paid to the city clerk for any application authorized by this section, and any penalties for non-payment or late payment.

D. Additional Conditions and Restrictions. The city council may, by chapter, promulgate additional conditions and restrictions for the issuance, revocation, suspension, renewal, and/or reinstatement of permits.

5.20.040 - Business license.

In addition to the payment of any required application fee, upon the issuance of a permit the person to whom it is issued shall, before offering any short-term rentals, apply and pay the fee for a city business license. Upon any failure on the part of the applicant to timely obtain and maintain the business license in good standing, the city clerk may, upon ten days' written notice, suspend the short-term rental permit.

5.24.050. - Transient occupancy tax.

The holder of a short-term rental permit shall pay to the city a transient occupancy tax in the same amounts and on the same terms and conditions as is then required of hotels and motels operating within the city.

5.24.060 - Lease restrictions.

Nothing in this chapter shall be deemed to allow lessees of premises to offer the leased premises for short-term rental occupancy where the lease prohibits it.
