5.08.010 Definitions.¶
As used in this chapter, the following definitions shall apply:
"Amusement machine" means any mechanical, electrical, electronic or other machine, apparatus, contrivance, or device, which may be operated or played by placing or depositing therein a coin, check, slug, ball, token, card or other article, or by paying for the use thereof in advance or after use, involving in its operation or play either skill or chance, including, but not limited to, pinball machines, bowling game machines, video game machines or any other similar machine or device. The term "amusement machine" does not include phonographs, jukeboxes, or other music machines.
"Amusement machine business" means any business with a fixed place of business which maintains on the business premises one or more amusement machines available for use and play by the public generally or by patrons of such business, whether such amusement machine business is conducted as a single business or in conjunction with another business. (Ord. 473 §1, 2002).
5.08.020 Location.¶
All the amusement machines available for use and play in or about an amusement machine business shall be located together in one area, readily visible and accessible to the public and all patrons of the business. (Ord. 473 §1, 2002).
5.08.030 Supervision.¶
At all times during the operation of any amusement machine at the business premises of an amusement machine business an adult attendant (eighteen years of age or older) shall be present to supervise the conduct of all persons present, to maintain proper order and good behavior, and to guard against any conduct which is, or is reasonably likely to be detrimental to public health, safety or welfare. (Ord. 473 §1, 2002).
5.08.040 Bicycle parking.¶
The person to whom a license is issued by the city for an amusement machine business shall provide adequate parking space for bicycles, either inside or outside the business premises, and shall not permit the parking of bicycles or other obstruction on any portion of the public right-of-way for pedestrians adjoining the business premises. (Ord. 473 §1, 2002).
5.08.050 Alcoholic beverages.¶
No alcoholic beverages shall be consumed on the business premises of an amusement machine business unless such business is conducted in conjunction with a bar, restaurant, or other business licensed to serve alcoholic beverages for consumption on the business premises. (Ord. 473 §1, 2002).
5.08.060 Violation--Penalty.¶
A violation of this chapter shall constitute an infraction and shall be punishable by:
A. A fine not exceeding fifty dollars for a first violation;
B. A fine not exceeding one hundred dollars for a second violation within one year; or
C. A fine not exceeding two hundred fifty dollars for each additional violation within one year. (Ord. 473 §1, 2002).
