5.32.010 Compliance required.¶
A. No individual shall peddle or solicit without first having complied with the provisions of this chapter.
B. Compliance with the provisions of this chapter may be waived at the discretion of the collector. The collector may revoke such waiver at any time and require compliance with the provisions of this chapter. (Ord. 9517 § 1 (part), 1995: prior code § 6300)
5.32.020 Application process.¶
A. A business tax application can not be completed and the fees paid until the following process is completed:
Step One. Furnish his/her fingerprints and thumbprints, to be taken by the police department. The police department does charge a fee and the fee will be paid by the individual;
Step Two. The individual will then send the fingerprint/thumbprint card to the Department of Justice in Sacramento. This card is then returned to the finance office for approval. The department of justice also has a fee for this process;
Step Three. With the finance office's approval, a business tax application can then be completed and the fees paid.
B. The manager/owner must provide a list of sellers. Only the persons on the list will be permitted to peddle or solicit. It is only necessary for the manager/owner to furnish the fingerprint/thumbprint card. All persons on the list shall carry credentials showing he/she is an authorized employee or representative of the employer. Each persons shall also carry a copy of the business tax certificate to be shown when asked for. (Ord. 9517 § 1 (part), 1995: prior code § 6301)
5.32.030 Business tax certificate required.¶
No individual shall peddle or solicit without having a valid, and in effect, business tax certificate from the city to do so at the time. (Ord. 9517 § 1 (part), 1995: prior code § 6307)
5.32.040 Hours of peddling and/or soliciting.¶
No individual shall peddle or solicit before the hour of nine a.m. of any day or after sunset or seven p.m. whichever is earlier. (Ord. 9517 § 1 (part), 1995: prior code § 6308)
5.32.050 Violations.¶
Any of the following shall be considered a violation pursuant to this chapter:
A. False Application. Fraud, misrepresentation, or any false statement contained in application for business tax certificate;
B. False Information. Fraud, misrepresentation, or any false statement made to the police department in furnishing the information required pursuant to this chapter;
C. Improper Peddling, Soliciting. Conducting the peddling or soliciting in an unlawful manner or in such a manner as to constitute a breach of the peace or to be a menace to the health, safety or general welfare of the people of the city. (Ord. 9517 § 1 (part), 1995: prior code § 6305)
