Sec. 17-3.1. - Amount of Bond Required.¶
All persons installing swimming pools and spas within the City shall, prior to building permit, post a cash bond in the amount set by the City Council through a fee resolution. In addition, said person shall pay a fee in an amount set by City Council through a fee resolution to defray the administrative expenses and inspection costs incurred by the City. Said fee shall be payable to the City and shall be in addition to any building permit fee paid.

Sec. 17-3.2. - Duty of City Clerk.¶
The City Clerk shall hold said bond until the swimming pool or spa has been completed, and received its final inspection and approval by the Department of Building and Safety.

Sec. 17-3.3. - Inspection by City Clerk or City Engineer.¶
Upon completion of the pool or spa and final approval by the Building and Safety Department, the City Clerk or the City Engineer shall visually inspect the streets in the vicinity of the new construction to determine if the streets have been properly cleaned and to determine that there has been no damage to City curbs and/or streets.

Sec. 17-3.4. - Release of Bond.¶
The City Clerk shall withhold from said cash deposit such sum as the City Clerk shall determine is necessary to clean the streets and make the necessary repairs, plus an annually adjusted administrative overhead charge of a percentage of the bond, and release the balance of said bond to the property owner.

Sec. 17-3.5. - Duty of Director of Building and Safety.¶
The Director of Building and Safety is directed to withhold issuing any building permits for any pool or spa until the City Clerk notifies him that the bond has been received.
