Sec. 17-2.1. - Bond or Insurance Required.

Any person desiring to dig or trench in the streets for laying of pipe, conduit or other work in said street, by which the surface of the street will be disturbed or torn up, must before beginning such work deposit with the City a bond as required by Article 17-1 of this Chapter as a guaranty that said person will replace the street in as good condition as it was before said work was done. The amount of the bond shall be established by the City Council through a fee resolution as advised by the City Engineer. Eighty (80) percent shall be returned upon final acceptance by the City Engineer, and the remaining twenty (20) percent shall be retained for one (1) year. In addition, said person shall pay a fee in an amount set by City Council through a fee resolution to defray the administrative expenses and inspection costs incurred by the City. Said fee shall be payable to the City.

Sec. 17-2.2. - Permit Required.

Every person desiring to dig in the streets of the City for the purpose of laying gas pipe, water pipe, sewer or other work in said streets, by reason of which the surface of the said street will be disturbed or turn up or broken, must, before beginning such work, obtain a written permit from the City designating the time and place and the amount and character of said work to be performed. This provision shall not apply to any of the employees of the City.

Sec. 17-2.3. - Restrictions Regarding Street Excavations.

No excavation shall be allowed in any public street, alley or other public place for a period of three years from the completion of resurfacing or reconstruction. The City Engineer shall establish rules and regulations to allow exceptions to this section when such exceptions would benefit the public. The cost of any and all inspections, together with any administrative costs shall be borne by the permittee. Immediately upon completion of the work necessitating the excavation, the permittee shall restore the property in a prompt and workmanlike manner to its original condition, in accordance with the requirements of the City Engineer. Further remedial work made necessary by settlement or other construction-related condition shall immediately, upon notification, be completed by the permittee to the satisfaction of the City Engineer.

Sec. 17-2.4. - Repairs.

All persons digging the surface of any street of the City shall by proper means repair the street so as to comply with Article 17-1 of this chapter.

Sec. 17-2.5. - Appeal to Council.

Should any person be aggrieved by any act under this section after notice given to the City Manager, such person may appeal to the City Council. The City Council shall hear and determine the issues as in other cases of appeal to the City Council.

Sec. 17-2.6. - Excavations Under Streets.

No person shall construct or excavate any basement, elevator, elevator shaft, tunnel or other excavation, under any public street in the City beyond a point one-half the distance from the property line abutting such street to the curb of such street.

The provisions of this subsection do not apply to temporary excavations in or under the public streets permitted by other provisions of this Code, nor do they apply to public utilities excavating in or under the City streets, under the valid exercise of a City franchise.
