Chapter 17.108 — PUBLIC HEARING AND NOTICE WHERE REQUIRED

17.108.010 - Public hearing—Required.

Whenever a public hearing is required pursuant to the provisions of the Subdivision Map Act or this title or is ordered to be held by the city council, the public hearing shall be held and notice given thereof as provided by Section 66451.3 of the Subdivision Map Act and this title.

17.108.020 - Public hearing—Notice.

Notice of the time and place of the hearing including a general description of the location of the subdivision or proposed subdivision or improvement and area to be affected shall be given at least ten days before the date of hearing thereon. Such notice shall be given by publication once in a newspaper of general circulation, published and circulated within the city. In addition, such notice shall be given by mail not less than ten days prior to the date of the public hearing to the owners of all property within three hundred feet of the exterior boundaries of the proposed subdivision as shown on the last adopted tax roll of the county.

17.108.030 - Failure to notify.

Failure to receive the notice as required by this title shall not invalidate any action taken pursuant to this title and the Subdivision Map Act.

17.108.040 - Public hearing—Procedure.

At the time set for public hearing the planning commission and/or city council shall give any interested person who appears and so requests an opportunity to be heard with regard to the matter which is the subject of the public hearing. At the conclusion of the hearing, the planning commission and/or city council shall take such action as they deem appropriate within the provisions of the Subdivision Map Act and this title.

17.108.050 - Public hearing—Notification of decision.

The planning commission and/or city council shall within ten days following the conclusion of the public hearing express by resolution in writing their decision on the matter under consideration. The resolution of the planning commission and/or city council shall specify the reasons for the decision and it shall accompany the decision with the findings of fact. A copy of the decision shall be transmitted to the subdivider or to the appellant, if any, and to such other persons or entities as deemed appropriate by the planning commission and/or city council.
