Chapter 16.08

• A. Required. In accordance with Section 66490 of the California Government Code, prior to the approval of any final map, there must be submitted to the Building Department of the City a preliminary soil report prepared by a Civil Engineer who is registered by the State, based upon adequate test borings or excavations.

• B. Waiver. The preliminary soil report may be waived if the building department of the City shall determine that due to the knowledge of such department as to the physical properties of the soil of the subdivision or lot no preliminary analysis is necessary.

• C. Findings Requiring Soil Investigation. If the preliminary soil report indicates the presence of critically expansive soils or other soil problems which, if not corrected, would lead to structural defects, then the applicant shall submit to the Building Department a soil investigation of each lot in such subdivision.

Such soil investigation shall be prepared by a civil engineer who is registered in the State and shall include recommendations for corrective action which is likely to prevent structural damage to each building proposed to be constructed on the expansive soil. (Prior code § 28.18)

If such recommendations are made, such recommended action must be incorporated in the construction of each dwelling located upon such subdivision. (Prior code § 28.19)

The Building Department of the City, if it determines that the recommended action is likely to prevent structural damage to each dwelling to be constructed, shall approve the soil investigation.

The City shall not be liable for any injury which arises out of any act or omission of the City or a public employee thereof or any other person administering or enforcing the foregoing sections or the provisions of the Health and Safety Code of the State, Sections 17953 through 17957, inclusive.
