16.315.010 License required.¶
After August 1, 1975, no resident shall ride, move, haul or leave standing, or allow to be ridden, moved, hauled, or left standing, any bicycle on any road, street, highway or other public property within the city of San Buenaventura unless such bicycle has been licensed in accordance with this chapter or has been licensed in accordance with former Ordinance Code Section 7611 et seq.
This chapter does not apply to bicycle manufacturers or bicycle dealers transporting bicycles in the normal course of business. (Code 1971, § 7621.1)
16.315.020 License permitted.¶
Any bicycle not subject to the provisions of this chapter may be licensed upon request of the owner. (Code 1971, § 7621.2)
16.315.030 Term of license.¶
Unless otherwise stated in this chapter, each license issued pursuant to this chapter shall be valid for a period of three years from the date of issuance. (Code 1971, § 7621.3)
16.315.040 Expiration of licenses issued under former provisions of ordinance code.¶
Licenses issued in accordance with former Ordinance Code Section 7611 et seq. shall remain valid until December 31, 1978, at which time said licenses shall expire. (Code 1971, § 7621.4)
16.315.050 Obtaining registration forms and licenses – Use and content.¶
A. Each bicycle owner shall acquire from the business license division or other designated agent a registration form which shall include, but not be limited to, the following written information:
Name.
Address.
Bicycle serial number.
Bicycle license number.
Make of bicycle.
Type of bicycle.
B. Upon completion of the registration form and payment of the proper fee, each bicycle owner shall receive a bicycle license from the designated agent which shall be affixed to the bicycle frame and which shall be permanently assigned to the bicycle. (Code 1971, § 7621.5)
16.315.060 Distribution of copies of registration form.¶
One copy of the registration form as to each bicycle registered shall be given to each of the following:
A. The police department.
B. The bicycle owner. (Code 1971, § 7621.6)
16.315.070 License fee.¶
Each bicycle owner shall pay a license fee computed at a rate of not more than $2.00 per year for each bicycle licensed. Revenues from licensing shall be retained by the city and shall be used for the enforcement of the bicycle ordinance, the implementation of bicycle safety programs, or the establishment of bicycle facilities, including bicycle paths and lanes within the city. Bicycle license fee revenues which, prior to the effective date of this chapter, were used for other purposes may continue to be used for the same purposes for a period not exceeding one year from the effective date of this chapter. 16.315.080 Serial number.¶
No new bicycle shall be sold, registered, or licensed unless such bicycle has a unique serial number permanently stamped or cast into the head of its frame, either side of the seat down post tube, the rear drop-out, the toe plate or the bottom sprocket bracket, pursuant to the rules and regulations of the Department of Motor Vehicles. (Code 1971, § 7621.8)
16.315.090 Mutilation of license numbers or serial number.¶
It shall be unlawful for any person to willfully or maliciously remove, destroy, mutilate or alter the license number or serial number stamped, cast, or otherwise affixed to or on any bicycle pursuant to this chapter. (Code 1971, § 7621.9)
16.315.100 Renewal of expired license.¶
The owner of a bicycle may have an expired bicycle license renewed by the fire department or other designated agent upon presentation of the last issued registration form or its copy, and the fee prescribed by Section 16.315.070. The renewal of a bicycle license shall be indicated by a supplementary adhesive device affixed on or near the license indicia. (Code 1971, § 7621.10)
16.315.110 Notice of sale.¶
Whenever the owner of a bicycle licensed pursuant to this chapter sells or otherwise disposes of a bicycle, the owner shall within 10 days notify the police department of such disposition. (Code 1971, § 7621.11)
16.315.120 Transfer of license to purchaser.¶
Any person who purchases or otherwise acquires possession of a bicycle shall within 10 days of taking possession apply for the transfer of license to their name. (Code 1971, § 7621.12)
16.315.130 Change of address.¶
Whenever the owner of a bicycle licensed pursuant to this chapter changes their address the owner shall within 10 days notify the police department of the old and new address. (Code 1971, § 7621.13)
16.315.140 Information required to be supplied by retailer to purchaser.¶
Each bicycle retailer shall supply to each purchaser a record of the following information:
A. Name of retailer.
B. Address of retailer.
C. Year and make of bicycle.
D. Serial number of bicycle. (Code 1971, § 7621.14)
16.315.150 Registration records.¶
The police department shall maintain records of each bicycle registered. Such records shall include but not be limited to the license number, the serial number of the bicycle, the make, type, and model of the bicycle, and the name and address of the licensee.
Records shall be maintained during the period of validity of the license or until receipt of written notification that the bicycle no longer is to be operated. (Code 1971, § 7621.15)
16.315.160 Violations.¶
Each violation of this chapter shall be an infraction. No fine imposed for a violation of this chapter shall exceed $5.00. (Code 1971, § 7621.16)
