16.140.010 Certain vehicles prohibited in central traffic district.

A. No person shall operate any of the following vehicles in the central traffic district between the hours of 8:00 a.m. and 6:00 p.m. of any day:

  1. Any freight vehicle more than eight and one-half feet in width, with load, or any freight vehicle so loaded that any part of its load extends to the rear of the vehicle beyond the last point of support for a greater distance than that equal to two-thirds of the length of the wheelbase of the vehicle; or (except as provided in Section 35406(b) of the Vehicle Code) extends more than three feet beyond the foremost part of the front tires of the vehicle or the front bumper of the vehicle, if it is equipped with a front bumper;

  2. Any vehicle carrying building material that has not been loaded, or is not to be unloaded, at some point within the central traffic district;

  3. Any vehicle conveying refuse, rubbish, garbage or aggregate materials (as that term is defined in Section 23114(d) of the Vehicle Code).

B. Provided, that the chief of police, with the approval of the city manager, may by written permit authorize the operation of any such vehicle for the purpose of making necessary emergency deliveries to or from points within the central traffic district. (Code 1971, § 7251)

16.140.020 Weight limit – Truck route.

A. Except as provided in Section 16.140.040, no person shall drive or operate any vehicle that weighs in excess of three and one-half gross tons (vehicle plus load) upon any street in the city of San Buenaventura except upon the following streets or portions of streets:

  1. Ventura Avenue from northerly city limits to Thompson Boulevard.

  2. Main Street from westerly city limits to Ventura Avenue.

  3. Olive Street from Main Street South.

  4. Thompson Boulevard from Ventura Avenue to Main Street (Five Points).

  5. Figueroa Street from Thompson Boulevard to Harbor Boulevard.

  6. California Street from Thompson Boulevard to Harbor Boulevard.

  7. Harbor Boulevard from the west end of the city limits to the east end of the city limits.

  8. Olivas Park Drive from Harbor Boulevard to easterly city limits.

  9. Spinnaker Drive from Harbor Boulevard West.

  10. Telegraph Road from easterly city limits to Main Street (Five Points).

  11. Kimball Road from Telegraph Road to Telephone Road.

  12. Victoria Avenue from Telegraph Road to the southerly city limits.

  13. Wells Road from Telegraph Road to the southerly city limits.

  14. Ventura Boulevard from North Bank to Victoria Avenue.

  15. Valentine Road/Market Street from Victoria to Arundell Avenue.

  16. McGrath Street/Transport Street from Portola Road to Fleet Avenue.

  17. Fleet Avenue from cul-de-sac to Transport Street.

  18. Morse Avenue from Market Street to Transport Street.

  19. Callens Road from Main Street to Transport Street.

  20. Walter Street from Bessemer Street to Transport Street.

  21. Donlon Street from Main Street to Transport Street.

  22. Goodyear Avenue from Westinghouse Street to Dupont Street.

  23. Eastman Avenue from Valentine Road to Ortega Street.

  24. Palma Drive from Valentine Road to Ortega Street.

  25. Portola Road from Market Street to Colt Street.

  26. Knoll Drive from Valentine Road to Sperry Avenue.

  27. Sperry Avenue from Valentine Road to Colt Street.

  28. Olivas Park Drive from westerly city limits to Golf Course Drive.

  29. Bunsen Avenue from Nicolle Street to Olivas Park Drive.

  30. Golf Course Drive from Leland Street to Olivas Park Drive.

  31. Leland Drive from Golf Course Drive to Ventura Road.

  32. Johnson Drive from North Bank Drive to Ventura Road.

  33. North Bank Drive from Ventura Boulevard to Johnson Drive.

  34. Main Street from Five Points to Telephone Road.

  35. Telephone Road from Olivas Park to Wells Road.

  36. San Jon Road from Thompson Boulevard to Harbor Boulevard.

  37. Seaward Avenue from Thompson Boulevard to Harbor Boulevard.

  38. Johnson Drive from Telephone Road to North Bank Drive.

B. The streets or portions of streets listed in subsection A of this section are hereby designated as the city’s truck route. For purposes of Section 16.140.040 and subsection G of this section, streets and portions of streets that are not part of the truck route shall be referred to as “restricted streets.”

C. The provisions of this section do not apply to any vehicle that is subject to Sections 1031 to 1036, inclusive, of the Public Utilities Code.

D. The provisions of this section do not apply to (1) any state highway that is included in the National System of Interstate and Defense Highways, unless and until the ordinance enacting this section is submitted to and approved by the California Transportation Commission as provided in Section 35701(c) of the Vehicle Code; or (2) any other state highway unless and until the ordinance enacting this section is submitted to and approved in writing by the Department of Transportation as provided in Section 35702 of the Vehicle Code.

E. This section shall not be effective until appropriate signs are erected at appropriate intervals along the city’s truck route indicating the streets and portions of streets that constitute the city’s truck route. The city traffic engineer is authorized and directed to erect such signs.

F. This section shall not apply to any vehicle owned by a public utility or a licensed contractor while necessarily in use in the construction, installation, or repair of any public utility.

G. This section does not prohibit a commercial vehicle that is coming from any street that is a part of the truck route from having ingress and egress by direct route to and from a restricted street when such ingress or egress is necessary for the purpose of making pickups or deliveries of goods, wares, and merchandise from or to any building or structure located on the restricted street or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling, or construction of any building or structure upon the restricted street for which a building permit has previously been issued.

H. This section shall not apply to any vehicle owned, leased, operated or controlled by any licensed contractor while necessarily in use in the construction, maintenance, or repair of a public works project, or by any highway carrier regulated by the Public Utilities Commission while transporting any materials to or from a public works project, when the bids were opened prior to the adoption of the ordinance adding this section to the city’s municipal code unless an alternate direct route is provided substantially within and by the city. 16.140.030 Oversized vehicles.

Except as provided in Section 16.140.040, and except as otherwise provided in the Vehicle Code, no person shall operate any of the following vehicles upon any street in the city of San Buenaventura:

A. Any vehicle or combination of vehicles that is more than eight and one-half feet in width, with load;

B. Any vehicle that is more than 14 feet in height, with load, measured from the surface of the road to the top of the load, if any;

C. Any vehicle that is more than 40 feet in length, measured from the front bumper of the vehicle to the rearmost part of the vehicle;

D. Except as provided in subsection E of this section, any combination of vehicles coupled together, including any attachments, that exceeds a total length of 65 feet;

E. Any combination of vehicles coupled together, including any attachments, which consists of a truck tractor, a semitrailer, and a semitrailer or trailer, if the combination of vehicles exceeds a total length of 75 feet, and if either the semitrailer or the trailer in the combination of vehicles exceeds 28 feet six inches. 16.140.040 Special permit – Overweight and oversized vehicles.

Upon application in writing, and if good cause appears, the city engineer may grant a special permit in writing authorizing the applicant to operate a vehicle that weighs in excess of three and one-half gross tons upon a restricted street. Upon application in writing and if good cause appears, the city engineer may grant a special permit in writing authorizing the applicant to operate a vehicle that exceeds the height, width, or length limitations set forth in Section 16.140.030 upon those city streets specified in the special permit. The application for any such permit shall be made on a form approved by the city and shall specifically describe the vehicle and load to be operated or moved, the height, width, and length of the vehicle, and the particular street or streets over which permit to operate is requested. The city engineer is authorized to withhold such permit in their discretion. In the event the city engineer issues the same, they may limit or prescribe conditions of operation of such vehicle to protect the public and assure against damage to road surfaces or foundations, bridges, or other structures. Every such permit shall specify the vehicle and street or streets to which it applies, and set out the time or times and the date or dates within which the vehicle may be operated on the streets indicated. No permit issued pursuant to this section shall be issued for a period of time in excess of 365 days. Every such permit shall be carried in the vehicle to which it refers, and shall be subject to inspection upon request by any police or traffic officer, or any officer or employee charged with the care or protection of such streets. Applications for permits pursuant to this section shall be filed with the city engineer at least 48 hours before the date on which the vehicle for which a permit is requested is to be operated upon city streets. 16.140.050 Special permit fee.

An applicant for a special permit, under Section 16.140.040, shall pay to the city engineer, at the time of filing the application for the special permit, a fee in an amount which shall be set by resolution adopted by the city council. No such fee shall be refundable. Special services necessitated by unusually large or heavy loads requiring engineering investigations, escorts, tree trimming, or other services shall be billed to, and paid by, the applicant separately for each permit. The city’s billing for special services shall be based on the cost to the city of providing the special services. (Code 1971, § 7255)

16.140.060 Vehicles prohibited from using certain streets.

A. The city council may, by resolution, designate and declare any street or portion thereof as a street, the use of which is prohibited by any commercial vehicle over a specified weight. Those streets or portions of streets so established by resolution of the city council are hereby declared to be streets, the use of which is prohibited by any commercial vehicle over the specified weight.

B. The city council may, by resolution, designate and declare any residential street or portion thereof as a street, the use of which is prohibited by certain classes or types of vehicles as may be specified in such resolution. Those residential streets or parts of streets so established by resolution of the city council are hereby declared to be streets, the use of which is prohibited by any vehicle belonging to the classes or types prohibited or restricted by such resolution. “Residential street,” as used in this subsection B, means any street or portions of street which is designated as a “local” street on the circulation plan map referenced in the city’s comprehensive plan, as it may be amended from time to time.

C. After the adoption or amendment of any resolution pursuant to this section, the city traffic engineer shall erect and maintain appropriate signs providing notice of whatever prohibitions or restrictions are established on those streets or portions of streets affected by such action of the city council.

D. The provisions of this section, or any resolution adopted pursuant to this section, shall not apply to:

  1. School buses;

  2. Passenger buses or any other common carriers licensed as passenger stage corporations under the jurisdiction of the Public Utilities Commission;

  3. Any vehicle used for the collection or transportation of garbage, trash, refuse, or recycled materials while necessarily in use in the collection or transportation of such materials to or from locations on a restricted street;

  4. Any vehicle owned by a public utility or a licensed contractor while necessarily in use in the construction, installation, or repair of any public utility; or

  5. Any vehicle owned, leased, operated or controlled by any licensed contractor while necessarily in use in the construction, maintenance, or repair of a public works project, or by any highway carrier regulated by the Public Utilities Commission while transporting any materials to or from a public works project, when the bids were opened prior to the adoption of Ordinance No. 96-16 unless an alternate direct route is provided substantially within and by the city.

E. This section does not prohibit a commercial vehicle that is going to or coming from any street that is a part of the city’s truck route as designated by Section 16.140.020 from having ingress or egress by direct route on or along a restricted street when such ingress or egress is necessary for the purpose of making pickups or deliveries of goods, wares, and merchandise from or to any building or structure located on the restricted street or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling, or construction of any building or structure upon the restricted street for which a building permit has previously been issued. 16.140.070 Violations.

Except as otherwise provided in Section 35784 of the Vehicle Code, any violation of any of the terms and conditions of any permit issued pursuant to the provisions of Section 16.140.040 is a violation of the provisions of Section 35784 of the Vehicle Code and is punishable as provided in Section 35784 of the Vehicle Code. Transporting an extra legal load on any street in the city, or causing or directing the operation of or driving on any street in the city any vehicle or combination of vehicles for which a permit is required pursuant to the provisions of this chapter, without having obtained a permit issued in accordance with Section 16.140.040, is a violation of the provisions of Section 35784.5 of the Vehicle Code and is punishable as provided in that section.
