Sec. 24.505.010. Chapter Description.

Chapter 24.505 establishes the director’s permit procedure. This chapter is intended to provide a procedure for review and decisions regarding director’s permits. (Code 1971, § 15.805.010)

Sec. 24.505.020. Applicability.

A director’s permit may be issued for certain minor administrative land use decisions or determinations that do not require a public hearing. Such decisions or determinations include, but are not limited to, interpretation of the official zoning district map, density review, classification of proposed uses, approval of certain temporary uses or signs, minor changes, and extensions of time periods for initiation of use or start of construction that may be specified in permits or other approvals issued pursuant to this zoning ordinance. (Code 1971, § 15.805.020)

Sec. 24.505.030. Review Process and Action by Director.

An application for a director’s permit shall be reviewed and acted upon by the director of community development. The director may approve, approve with conditions, disapprove, or forward to the planning commission, with or without recommendation, any director’s permit application. (Code 1971, § 15.805.030)

Sec. 24.505.040. Initiation.

A director’s permit application may be initiated in the manner prescribed by section 24.500.030 or by the director. (Code 1971, § 15.805.040)

Sec. 24.505.050. Notice and Hearing.

Notice and a public hearing are not required for issuance of a director’s permit unless the director decides to forward the application to the planning commission. If a director’s permit application is referred to the planning commission for review and action, notice and hearing shall be provided in the manner prescribed by chapter 24.560. (Code 1971, § 15.805.050)

Sec. 24.505.060. Conditions of Approval.

The director, in approving an application for a director’s permit, may impose such conditions as the director deems necessary or desirable to insure that the project or use authorized by the director’s permit will be established, occupied, and maintained in accordance with all requirements of this zoning ordinance, this Code, and other provisions of law. The director may further require reasonable guarantees and evidence that such conditions are being, or will be, complied with. Such conditions imposed by the director may involve any factors affecting the establishment, occupation or maintenance of the proposed project or use. (Code 1971, § 15.805.060)

Sec. 24.505.070. Appeals.

A decision of the director relating to an application for a director’s permit, or any other final determination by the director pursuant to this zoning ordinance, may be appealed to the planning commission as provided by chapter 24.565. (Code 1971, § 15.805.070)

Sec. 24.505.080. Expiration.

A director’s permit shall expire by operation of law without any action by the director if the project or use authorized by such permit is not commenced or diligently pursued, or construction necessary and incident thereto is not begun or diligently pursued on or before the time limit specified in such director’s permit, and thereafter diligently advanced, or if no time is specified, on or before 60 days after the date such director’s permit was approved. (Code 1971, § 15.805.080)

Sec. 24.505.090. Failure to Comply With Conditions.

Failure to comply with any of the terms or conditions of an approved director’s permit is a violation of the zoning ordinance subject to the enforcement provisions prescribed by chapter 24.580 and any and all other penalties and remedies that may be provided by law. A director’s permit may be revoked, or the conditions of its approval may be reevaluated, as provided by chapter 24.570. (Code 1971, § 15.805.090)

Sec. 24.505.100. Permit Amendment.

An amendment to a director’s permit shall be required as provided by chapter 24.570 as follows:

  1. Change the terms or conditions of the director’s permit; or

  2. Expand the scope of the project or use authorized by the director’s permit. (Code 1971, § 15.805.100)
