15.18.010 - Title and purpose.

The purpose of Section 15.18.010 through Section 15.18.060, inclusive, is to create and establish the city's regulations, standards and procedures for reversions to acreage.

15.18.020 - Reversion process.

A. Proceedings for reversion to acreage shall be initiated by the city council or by petition of all of the owners of record of the real property within the subdivision.

B. In the case of initiation by the owners, the petition shall be submitted to the planning division and shall contain the following:

  1. Adequate evidence of title to the real property within the subdivision;

  2. Sufficient data to enable the city council to make the findings required in Section 15.18.030;

  3. A final map which delineates dedications which will not be vacated and dedications as required by Section 15.18.040; and

  4. Such other additional data as required by the development services director and/or public works director.

C. A public hearing shall be held on the proposed reversion to acreage. Notice of such hearing shall be given in the time and manner provided in Section 15.08.040(D).

D. Reversion shall become effective upon the final map being filed for record by the county recorder, and thereupon all dedications and offers of dedication not shown thereon shall be of no further force or effect.

15.18.030 - Findings for reversion.

Subdivided real property may be reverted to acreage only if the city council finds that:

A. Dedications or offers of dedication to be vacated or abandoned by the reversion to acreage are unnecessary for present or prospective public purposes; and

B. Either:

  1. All owners of an interest in the real property within the subdivision have consented to reversion; or

  2. None of the improvements required to be made have been made within two years from the date the final or parcel map was filed for record, or within the time allowed by agreement for completion of the improvements, whichever is the later; or

  3. No lots shown on the final map or parcel map have been sold within five years from the date such map was filed for record.

15.18.040 - Conditions for reversion.

As conditions of reversion, the city council shall require:

A. Dedication or offers of dedication necessary for streets, public rights-of-way or easements;

B. Retention of all previously paid fees, deposits and/or improvement securities if necessary to accomplish the purposes of this chapter and the Subdivision Map Act.

15.18.050 - Authorization for parcel map.

The city may authorize a parcel map to be filed under the provisions of this chapter for the purpose of reverting to acreage land previously subdivided and consisting of four or less contiguous parcels under the same ownership. This authorization shall comply with the requirements of the Subdivision Map Act.

15.18.060 - Merging and resubdividing without reversion.

Subdivided lands may be merged and resubdivided without reverting to acreage by complying with all the applicable requirements for the subdivision of land as provided by this title and the Subdivision Map Act.
