§ 5.60.130. Massage technicians—Permit required.

A. It is unlawful for any person to engage in the business of acting or to act as a massage technician unless such person holds a valid massage technician permit issued by the city. Each massage technician permit holder shall be issued a photo identification badge which will also serve as a massage technician permit. The permit holder shall maintain the massage technician permit visibly on his or her person during business hours. Each permit holder shall immediately surrender to the chief any massage technician permit issued by the city upon the suspension, revocation, or expiration of such permit. Effective September 1, 2009, any person currently licensed by the California Massage Therapy Organization as a "massage therapist" or "massage practitioner" shall not be required to obtain a permit from the city. Effective December 31, 2010, all massage technician permits issued by the city shall expire. Effective January 1, 2011, each person employed for the purpose of providing massage services must be licensed as a "massage therapist" or "massage practitioner" by the California Massage Therapy Organization pursuant to the California Business and Professions Code Sections 4600 through 4620.

B. A permit under this section shall be valid for 12 months from the date of issuance unless revoked or suspended. Massage technicians currently licensed by the city may continue to provide massage services until December 31, 2010, regardless of the expiration date of their city license. The city reserves the right to revoke city licenses pursuant to the municipal code. Effective September 1, 2009, all new applicants shall be referred to the California Massage Therapy Organization to obtain a state license. Effective January 1, 2011, all massage technicians must be licensed by the state of California as described in subsection A of this section.

§ 5.60.150. Massage technicians—Renewal.

Unless grounds for permit suspension or revocation currently exist, a massage technician permitted under this article may obtain renewal of a current, valid city issued permit by providing the chief with satisfactory evidence of having passed any written examination required for new permit applicants pursuant to Section 5.60.140(S), submitting the medical certificate required of new permit applicants pursuant to Section 5.60.140(J), and paying a renewal fee as established by the city council to defray, in part, the cost of administering the renewal process required by this section, prior to expiration of the current permit. Massage technicians wishing to renew their current valid permit may take the written examination no more than six months prior to expiration of the current permit, and may retake the examination as needed, provided, however, that evidence of passage of the examination, and medical certificate, must be received by the chief prior to the date of expiration of the current valid permit or the permit shall expire and the massage technician shall be required to complete the application process for a new permit. Massage technicians currently licensed by the city may continue to provide massage services until December 31, 2010, regardless of the expiration date of their city license (unless revoked pursuant to this code). Effective September 1, 2009, all new applicants shall be referred to the California Massage Therapy Organization to obtain a state license. Effective January 1, 2011, all massage technicians must be licensed by the state of California as described in Section 5.60.130(A) of this code.
