3.28.010 - Definitions.

For the purposes of this chapter, unless otherwise apparent from the context, certain words and phrases used in this chapter are defined as follows:

(a) "Chief" shall mean the Chief of Police.

(b) "Reserve" shall mean the Tracy Police Reserve.

(c) "Member" shall mean any member of the Tracy Police Reserve.

3.28.020 - Creation of the Tracy Police Reserve.

The Tracy Police Reserve is hereby created. The Reserve, consisting of not more than thirty (30) persons, shall be appointed by the City Manager and shall be under the direction of the Chief. The Chief shall annually appoint a Reserve captain. The members of the Reserve shall annually elect by secret ballot such number of Reserve sergeants as may be necessary for the proper organization of the Reserve unit. The Chief may remove from office any member holding the office of Reserve captain or sergeant. The removed member may appeal to the City Manager for a review of the action of the Chief pursuant to section 3.28.090 of this chapter.

3.28.030 - Qualifications.

Applicants for membership in the Reserve unit shall meet the Standards of Training as set forth in sections 830.6 and 832.6 of chapter 5 of the Penal Code of the State.

3.28.040 - Public services to be rendered as ordered by the Chief of Police.

Members shall perform only such public services as may be ordered by the Chief, and it shall be unlawful for any person to wilfully resist, delay, or obstruct any member in the discharge or the attempt to discharge any duties of his office.

3.28.050 - Reserve duty to prepare against perils to life and property.

In addition to the duties assigned by the Chief, the Reserve is hereby assigned the duty of preparing against the perils to civilian life and property which may be expected to result from attack from or during war or from any disaster which may threaten lives and property in the City.

3.28.060 - Enforcement powers.

In the enforcement of the penal laws of the State, or the penal laws of the City, and in the performance of such other duties as may be designated by the Chief, every duly authorized member shall be deemed to have all the powers of a peace officer within the confines of their specific level of expertise, Level I, Level II, or Level III, as designated by the Peace Officer Standards and Training and the State.

3.28.070 - Uniforms and equipment.

The uniform, badge, and equipment to be worn and carried by the members shall be prescribed by the Chief.

3.28.080 - Unlawful to impersonate Reserve officers.

It shall be unlawful for any person to impersonate or falsely represent himself to be a member or to wear, use, or possess a badge used by the Reserve.

3.28.090 - Chief of Police may dismiss Reserve members.

The Chief may dismiss a member from the Reserve, and each member shall have the right to resign from the Reserve at any time.

3.28.100 - Uniforms and equipment—City's expense.

Uniforms, badges, and other equipment shall be purchased by the City at the City's expense. Upon the separation of any person from the Reserve Unit, the City property issued to him shall be returned to the Chief or his designee.

3.28.110 - Eligibility for membership.

To be eligible for membership in the Reserve, each applicant shall file an application for such membership and complete an examination process consisting of the following:

(a) Receive a passing score as established by the Personnel Department after being examined by an interview board appointed by the Personnel Department or its designee;

(b) The successful completion of a medical examination by a licensed physician selected by the Personnel Department;

(c) The successful completion of a psychological examination;

(d) The successful completion of an investigation into the background of the applicant by the Chief or his designee;

(e) Qualification in a physical agility test; and

(f) Requirements as set forth in sections 830.6 and 832.6 of the Penal Code of the State.

To be eligible, an applicant shall indicate a willingness to serve a minimum of sixteen (16) hours per month in the public service.

3.28.120 - Reserve members deemed public officers.

All persons appointed by the City Manager pursuant to the provisions of this chapter shall be deemed public officers.

3.28.130 - Members shall be registered with the Disaster Council.

Each member of the Reserve shall be registered with an accredited Disaster Council.

3.28.140 - Non-police activities of the Reserve.

The Reserve may sponsor, support, and participate in public services and activities beyond the scope of the activities set forth in this chapter provided such activities are first approved by the Chief.

3.28.150 - Rules and regulations.

The City Manager is hereby authorized, directed, and empowered to prepare and promulgate such rules and regulations, and revisions and amendments thereto, as may be necessary, in his discretion, to carry out the express intent of the provisions of this chapter.
