Tracy Municipal Code Art. 3 Service Charges and Fees

(a) The City Council may establish fees for the disposal of stormwaters, cooling water discharges, construction flush waters, drain water or other flows into the City's stormwater conveyance system and for the other services provided under this chapter. Such fees shall be fixed and established from time to time by resolution of the City Council. For purposes of determining the applicable stormwater fee, the Director shall estimate and determine the amount of stormwater, cooling water or construction flush waters each developed parcel within the City deposits into the City's stormwater conveyance system. In lieu of such estimate, any person may elect to pay a fee based upon metered discharged volume by providing, installing and maintaining in good working order an integrating meter satisfactory to the Director for the purposes of measuring such storm, cooling water or construction flush water.

(b) The City Council may establish charges for the inspection, sampling and analysis of stormwater flowing into the City's stormwater conveyance system. Such charges shall be fixed and established from time to time by resolution of the City Council.

The procedures applicable to the collection of service charges established pursuant to this chapter shall be those contained in chapter 11.32 of this Code, or such other procedures as the City Council may establish by resolution.
