86.3.1 UNDERGROUND STORAGE OF HAZARDOUS SUBSTANCES.

a) Pursuant to the provisions of the California Health and Safety Code, Chapter 6.7, Division 20, commencing at Section 25280, and as it may be amended, the Fire Department of the City is designated as the agency for administering and enforcing the provisions of said Chapter 6.7.

b) In order to implement said chapter, the Fire Chief shall:

  1. Enforce and administer the provisions of said chapter, all federal laws which are applicable, and regulations of the State Water Resources Control Board, or the Regional Water Quality Control Board which are applicable; and

  2. Prepare supplemental regulations from time to time to facilitate such enforcement and administration, as permitted by such Chapter 6.7.

c) This Section is an amendment of, and continuation of, Ordinance 3083 adopted December 20, 1983.

86.3.2 HAZARDOUS MATERIALS RELEASE RESPONSE PLANS AND INVENTORY.

a) Pursuant to the provisions of the California Health and Safety Code, Chapter 6.95, Division 20, commencing at Section 25500, and as it may be amended, the Fire Department of the City is designated as the agency for administering and enforcing the provisions of said Chapter 6.95.

b) In order to implement said Chapter 6.95, the Fire Chief shall:

  1. Enforce and administer the provisions of said Chapter 6.95, all federal regulations which are applicable and all regulations of the State Water Resources Control Board and the Regional Water Quality Control Board which are applicable; and

  2. Prepare supplemental regulations from time to time to facilitate such enforcement and administration, as permitted by said Chapter 6.95.

c) This Section is an amendment of, and continuation of, Ordinance 3161 adopted on January 21, 1986.

d) Any person who violates the provisions of Section 25507 of the Health and Safety Code shall be subject to the penalties provided in Section 25515 of the Health and Safety Code.
