20B-1 - Bicycle defined.

"Bicycle" for the purpose of this chapter, means any device upon which a person may ride which is propelled by human's power through a system of belts, chains, or gears and which has wheels of at least twenty inches in diameter and a frame size of at least fourteen inches.

20B-2 - Unlawful to operate without a license.

It is unlawful for any resident in the town to operate or use a bicycle upon any street, alley, lane, public highway, or any other property in the town without obtaining a license. Licenses when issued, shall entitle the licensee to operate such bicycles for which the license has been issued upon all streets, alleys, and public highways; exclusive of the sidewalks thereof in the town.

20B-3 - License; term; issuance; renewal.

The town police chief, or designee is authorized and directed to issue upon written application, bicycle licenses which will be effective for a period of not to exceed three years, to be designated by the State Director of Motor Vehicles. Renewal of a bicycle license shall be indicated by a supplementary adhesive device affixed on or near the indicia.

20B-4 - License indicia—Registration cards, issuance.

The town shall issue license indicia issued by the State Department of Motor Vehicles and registration cards. Said indicia and registration cards shall bear a unique license number. The chief of police shall maintain records of each bicycle registered. Such records shall include, but not be limited to, the license number, the serial number, the make, type, and model of the bicycle and the name and address of the licensee.

20B-5 - Recordation of transfer.

Whenever any person sells or otherwise disposes of a bicycle, he shall endorse upon the registration certificate previously issued for such bicycle a written transfer of same, setting forth the name, address, telephone, date of transfer, and signature of the transferrer; and shall deliver the registration certificate so endorsed to the Town of Tiburon within ten days of such sale or disposition. Any resident of Tiburon who purchases or otherwise acquires possession of a bicycle shall, within ten days of taking possession, apply for the transfer of license to his own name.

20B-6 - Change of address.

Whenever the owner of a bicycle licensed pursuant to this chapter changes his/her address, such person shall, within ten days, notify the chief of police of the old and new address.

20B-7 - License fee.

The license fee for each bicycle shall be as determined from time to time by resolution of the town council.

20B-8 - Impound bicycle—Registration required before release.

Any bicycle found, impounded, or recovered in the town that is not registered and licensed pursuant to this chapter shall be retained by the chief of police until the legal owner has properly licensed the bicycle. The fee schedule for registration of these bicycles will be the same as stated in this chapter.

20B-9 - Penalty.

Violation of any provision of this chapter is an infraction punishable by a fine of not more than one dollar for the first offense and for the second or subsequent offense(s) a fine of not more than five dollars.
