16C-1 - Title.¶
The ordinance codified in this chapter shall be known as the "Town of Tiburon recyclables collection area ordinance" and may be so cited.

16C-2 - Purpose and intent.¶
Cities and counties must divert fifty percent of all solid waste by January 1, 2000, through source reduction, recycling and composting activities. Diverting fifty percent of all solid waste requires the participation of the residential, commercial, industrial and public sectors. The lack of adequate areas for collecting and loading recyclable materials that are compatible with surrounding land uses is a significant impediment to diverting solid waste and constitutes an urgent need for state and local agencies to address access to solid waste for source reduction, recycling, and composting activities. This chapter has been developed to help meet that need.

16C-3 - Definitions.¶
The following definitions shall apply to the language contained in this chapter:
"Alteration" means a significant change in the principal elements of a structure including walls, roof, or floor, including enlargement of, or addition to the structure.
"Development project" means any of the following:
(1) A project for which a building permit is required for a commercial, industrial or institutional building, or marina, where solid waste is collected and loaded. Also any residential project where solid waste is collected and loaded in a central location serving five or more living units. This definition shall not apply to projects of the type or character for which solid waste collection is not required;
(2) A new public facility where solid waste is collected and loaded, and any alterations to areas of existing public facilities used for collecting and loading solid waste;
(3) The definition of development project only includes subdivisions or tracts of single-family detached homes if, within such subdivisions or tracts there is an area where solid waste is collected and loaded in a location which serves five or more living units. In such instances, recycling areas as specified in this chapter are only required to serve the needs of the living units which utilize the solid waste collection and loading area.
"Floor area of a marina," for the purposes of this chapter, means the number of spaces dedicated to the docking or mooring of marine vessels. For example, an increase in the number of berths from one hundred to one hundred thirty shall be considered a thirty percent increase in the "floor area" of the marina.
"Public facility" includes, but is not limited to, buildings, structures, marinas and outdoor recreation areas owned by a governmental agency.
"Recycling area (areas for recycling)" means space allocated for collecting and loading of recyclable materials. Such areas shall have the ability to accommodate receptacles for recyclable materials. Recycling areas shall be accessible and convenient for those who deposit as well as those who collect and load any recyclable materials placed therein.

16C-4 - Responsibility for administration.¶
This chapter shall be administered for the town by the planning director. The planning director shall ensure that all planning and building permits are designed to comply with this chapter.

16C-5 - Construction and application.¶
This chapter shall be construed to assure consistency with the requirements of California Public Resources Code section 42911 and acts amendatory thereof or supplementary thereto, and any applicable implementing regulations.
