Sec. 5-9.01. Definitions.

For the purposes of this chapter, unless otherwise apparent from the context, certain words and phrases used in this chapter are defined as follows:

(a) “Establishment” shall mean and include a hotel, motel, lodging house, guest house, boardinghouse, or other facility where sleeping accommodations are made available to the public.

(b) “Guest” shall mean and include a patron, lodger, or roomer.

(c) “Proprietor” shall mean and include the owner, manager, operator, desk clerk, or other employee whose duty it is to register patrons of the establishment.

Sec. 5-9.02. Registers: Required.

The proprietor of every establishment where sleeping facilities are made available to the public shall keep a register of all guests.

Sec. 5-9.03. Registers: Contents.

The register required by the provisions of this chapter shall contain for each guest:

(a) His name and address;

(b) The day, month, and year when such person registered;

(c) The number of rooms he occupied;

(d) The name and address of every person over the age of twelve (12) years who accompanied him; and

(e) If the registered person arrived by motor vehicle, the year, make, and model of the vehicle, together with the license number and the state issuing such license for the vehicle.

Sec. 5-9.04. Registers: Signatures of guests.

Before renting, furnishing, or otherwise making available any room or accommodation to any guest, the proprietor of the establishment shall require the guest to sign the register required by the provisions of this chapter.

Sec. 5-9.05. Registers: Maintenance as permanent record.

The registers required by the provisions of this chapter shall be a permanent record which shall be kept on the premises of the establishment for two (2) full calendar years next following the close of the establishment’s fiscal year.

Sec. 5-9.06. Registers: Display.

The registers required by the provisions of this chapter shall be available to any peace officer, as defined in the State Penal Code, for inspection in the normal course of the duties of such peace officers.

Sec. 5-9.07. Violations.

The proprietor of any establishment who wilfully refuses or fails to keep a register as required by the provisions of this chapter, or who wilfully refuses or fails to permit a peace officer to inspect, examine, or make copies of a register, shall be guilty of a violation of this Code pursuant to Section 1-2.01 of Chapter 2 of Title 1 of this Code.
