Sec. 5-3.01. Statement of necessity.¶
Recently residents adjacent to construction projects are experiencing discomfort and annoyance from contaminants discharged by reason of construction, and construction work in residential areas is in some instances endangering the property and health of residents adjacent to the construction area, and there exists a present damage and hazard to the public safety and health because of the air contaminants generated by construction in residential areas.

Sec. 5-3.02. Prohibited acts.¶
No person shall discharge, or cause to be discharged, from any source whatsoever such quantities of air contaminants or other materials which cause injury, detriment, nuisance, or annoyance to any considerable number of persons or to the public, or which endanger the comfort, repose, health, or safety of any such person or the public, or which cause, or have a natural tendency to cause, injury or damage to humans or property.

Sec. 5-3.03. Enforcement.¶
The Community Development Director shall be responsible for enforcing the provisions of this chapter.
