6.22.015 - County.¶
"County" shall mean the county of Tehama.

6.22.020 - Board.¶
"Board" shall mean the board of supervisors of the county of Tehama. If any territory covered by the franchise comes within the limits of any incorporated city, then as to such incorporated area, "board" means the legislative body of such city.

6.22.025 - Person.¶
"Person" shall mean any individual, person, firm, partnership or corporation.

6.22.030 - Grantee.¶
"Grantee" shall mean the person to whom the franchise is granted, and any person to whom it lawfully may be assigned.

6.22.035 - Highway.¶
"Highway" shall mean any public highway, freeway (except a state freeway), street, road, alley, lane or court or other public easement, and above and below the same, which now exists or which may hereafter exist in any unincorporated territory of the county and in which the county has the authority to grant a franchise.

6.22.040 - Industrial gas.¶
"Industrial gas" shall mean any substance which is in a gaseous state at ambient conditions of temperature and pressure used for commercial, industrial, or scientific purposes, but does not include any gaseous hydrocarbon used for light, heat, power, or feedstock.

6.22.045 - Facilities.¶
"Facilities" shall mean all property of the grantee, including service connections with the grantee's facilities, whether installed by the grantee or not, erected, constructed, laid, operated or maintained in, upon, over, under, along or across any highway pursuant to any right or privilege granted by the franchise.

6.22.050 - Service connection.¶
"Service connection" shall mean the wire, pipes, or conduits connecting the building or place where the service or commodity supplied by the grantee is used or delivered, or is made available for use or delivery, with the supply line or supply main in the highway or with such supply line or supply main on private property.

6.22.055 - Shall and may.¶
"Shall" is mandatory. "May" is permissive.

6.22.060 - Pipeline.¶
"Pipeline" shall include all real estate, fixtures, and personal property, owned, controlled, operated, or managed in connection with or to facilitate the transmission, storage, distribution, or delivery of oil, or products thereof, other fluid substances except water, and gas, including natural gas and gas which is toxic or corrosive, through pipeline.

6.22.065 - Pipeline corporation.¶
"Pipeline corporation" shall include every corporation or person owning, controlling, operating, or managing any pipeline for compensation within this state. "Pipeline corporation" shall not include a corporation or person employing a landfill gas technology and owning, controlling, operating, or managing any pipeline solely for the transmission or distribution of landfill gas or other form of energy generated or produced therefrom.

6.22.070 - Main.¶
"Main" shall mean any pipeline or conduit laid along or approximately parallel with and in any highway for the transmission or distribution of electricity or any substance or commodity.

6.22.075 - Franchise payment period.¶
The "franchise payment period" is the first year after the effective date of the ordinance granting the franchise, or, at the option of the grantee, any shorter period of time immediately following the effective date of said ordinance, and each year thereafter, during the life of the franchise.

6.22.080 - Franchise report period.¶
The "franchise report period" in all cases shall mean the first year after the effective date of the ordinance granting the franchise, or, at the option of the grantee, any shorter period of time immediately following the effective date of the said ordinance and each year thereafter, during the life of the franchise.

6.22.085 - Road commissioner.¶
"Road commissioner" shall mean the road commissioner of the county. If any highway becomes a state highway, or if any territory covered by the franchise comes within the limits of any incorporated city, then as to such state highway or such incorporated area, "road commissioner" means the commission, board or officer of the state, or of such city, respectively, having powers and duties analogous or similar in such jurisdictions to the powers and duties of the road commissioner in the unincorporated territory of the county.
