3.28.050 - Fingerprinting and physical examination requirements.

A. All new employees except employees hired for thirty calendar days or less shall be fingerprinted and have a physical examination prior to receiving their first paycheck. Insofar as practicable, the fingerprinting and physical examination reports shall be obtained prior to the time the new employee commences work.

B. Fingerprint and physical examination may be waived by the department head with the consent of the board.

C. No employee shall be hired for county employment if he fails to pass the physical examination. Upon application of the hiring authority the board of supervisors may waive the requirement that a prospective employee pass the physical examination.

3.28.060 - Duties of sheriff's department-Filing and notification of department…

A. Upon receipt of the results of the record check from the Department of Justice, the sheriff's department will retain the record in its files and, if appropriate, shall notify the employee's department head if the subject does not meet the following criteria: No person convicted, including by pleas of guilty and nolo contendere, of any felony or crime chargeable as a felony shall be eligible for employment by any department of the county, except that the hiring authority may disregard such conviction if it is found and determined that mitigating circumstances exist, such as, but not limited to, evidence of rehabilitation, length of time elapsed since such conviction, the age of the person at the time of conviction, or the fact that the classification applied for is unrelated to such conviction.

3.28.070 - Statutory authority for distribution of criminal history records.

It is the intent of the ordinance codified in Section 3.28.060 and this section to comply with the provisions of California Penal Code Section 11105 concerning the distribution of criminal history records, and therefore department heads are authorized to be provided with the information contained in the criminal history of the applicant if such information is required to determine the relationship between the record of the individual and the job description.

3.28.080 - Application requirements.

A. The hiring authority shall require each applicant for county employment to complete and sign an application form stating the following things:

  1. The applicant's name, address and personal data;

  2. The applicant's work background;

  3. A written statement, signed by the hiring authority and the new employee and stating the facts which indicate that the new employee meets the minimum qualifications for the class in which he is being hired;

  4. Such other information as may be required by the board by minute order.

B. A copy of this application form shall be filed in the general roster.
