Tehama County Municipal Code Art. I Purpose of Chapter

To provide a compilation of the standard terms and conditions of franchises granted by the county and to be granted by the county of Tehama for the use of any public road and highway therein pursuant to Section 26001 of the Government Code and pursuant to Division 3, Chapter 2 (commencing at section 6201) of the Public Utilities Code (as amended).

When any ordinance granting a franchise, any franchise, or any notice or resolution pertaining to the franchise refers to the standard terms and conditions hereinafter set out, from and after the enactment of the ordinance codified in this chapter, they shall be a part thereof as if fully set out in the notice, resolution, franchise or ordinance.

Nothing herein shall prevent an ordinance, franchise, notice or resolution from containing additional or contrary terms and conditions specifically set out in such ordinance, franchise, notice or resolution. Every franchise hereafter granted by the county of Tehama for the use of county highways for any purpose, except as otherwise provided in the ordinance granting such franchise shall be granted upon and be subject to such of the following rules, regulations, restrictions, terms and conditions as are incorporated therein by reference, in addition to the rules, regulations, restrictions, terms and conditions set forth in the ordinance granting each such franchise. In the event of conflict between a provision as set forth in this chapter and a specific provision in an ordinance granting a franchise, the latter shall prevail.
