Chapter 16.36 — APPEALS

16.36.010 - Procedures-Submission-Hearing.¶
A.
Appeal from an action by the technical advisory committee may be made to the planning commission within fifteen days from such action.
B.
An appeal shall be submitted in written form to the secretary of the planning commission who shall set the matter for hearing.
C.
Such hearing shall be held within thirty days after the date of filing the appeal.
D.
Within ten days following the conclusion of the hearing, the commission shall render its decision on the appeal.

16.36.020 - Public hearing for dissatisfaction with decision.
A.
If a subdivider is dissatisfied with an action of the planning commission, he may within fifteen days after such action, appeal in writing to the board for a public hearing.
B.
Also within said fifteenday period, the planning commission shall forward the map or other documents to the board for review.
C.
The hearing shall be held within the time limit required by the Map Act.
D.
A public notice of such hearing shall be made by the clerk of the board.
E.
The board may continue such hearing from time to time, not to exceed fifteen days from the date of first hearing without mutual consent.
F.
At the time fixed for the hearing the board shall hear testimony of representatives of the commission or any witnesses on its behalf and any parties at interest.

16.36.030 - Board's consideration of facts.¶
The board shall consider the record and such additional evidence as may be offered and may affirm, reverse or modify, in whole or in part, the order, requirement, decision, recommendation, interpretation or ruling appealed from or make and substitute such other or additional decision or determination as it may find warranted under law and facts.

16.36.040 - Decision of the board.¶
The decision of the board as a result of the hearing shall be expressed by a motion in writing, and the board shall forthwith transmit a copy thereof to the subdivider and the commission.

16.36.050 - Filing of complaint with board by persons adversely affected.¶
A.
Any interested person adversely affected by a decision of the technical advisory committee or the planning commission may file a complaint with the board of supervisors concerning such decision.
B.
Any such complaint shall be filed with the board within fifteen days after the action and the hearing thereon shall be conducted in the manner provided by the Subdivision Map Act and this title.
