8.56.010 - Definitions.

As used in this chapter, the following words shall have the following definitions:

A. The term "alcoholic beverage" shall have the same meaning as in California Business and Professions Code Section 23004.

B. The term "tobacco products" shall mean any manufactured substance made from the tobacco plant, including, but not limited to, cigarettes, cigars, pipe tobacco, snuff, chewing tobacco and smokeless tobacco or products prepared from tobacco and designed for smoking and ingestion.

C. The term "city park" or "city parks" shall mean individually or collectively, Railroad Park, located at 207 East Tehachapi Boulevard, Depot Park located at 101 West Tehachapi Boulevard, Pioneer Park located at 111 West I Street, Warrior Park located at 1352 Classico Drive, Brave Park located at 115 Manzanita Lane, Aviator Park located on the Airport, and Centennial Plaza located at 114 South Green Street, all in Tehachapi, California.

8.56.020 - Prohibition of tobacco use.

It is unlawful for any person to light or smoke or chew or use in any other way any tobacco product at any time in any city park and the sidewalks adjacent to each without a special use permit authorizing the possession and use of tobacco products issued by the city. Such special use permits shall be maintained on-site at the city park or city parks where the tobacco products are used and shall be available for inspection by law enforcement or other city personnel.

8.56.030 - Prohibition of possession or consumption of alcoholic beverages.

It is unlawful for any person to possess or consume any alcoholic beverage at any time within any city park and the sidewalks adjacent to each without a special use permit authorizing the possession and consumption of alcoholic beverages issued by the city. Such special use permits shall be maintained on-site at the city park or city parks where the alcoholic beverages are used and shall be available for inspection by law enforcement or other city personnel.

8.56.040 - Penalty.

A first violation of Sections 8.56.020 or 8.56.030 shall constitute an infraction. Any additional violation of Section 8.56.020 or of Section 8.56.030 shall constitute a misdemeanor.
