4-7-1: DECLARATION OF POLICY:

It is the City's responsibility to promote the health, peace, safety, welfare and convenience of all persons in regard to their use and enjoyment of public lands. The City Council finds it necessary to prohibit the use of vehicles for vending for this purpose while ensuring that all such regulations comport with applicable law. (Ord. 852-23, 7-18-2023)

4-7-2: DEFINITIONS:

The following definitions apply to this chapter:

MOBILE FOOD TRUCK: A motorized vehicle or mobile food unit that should be licensed by the Department of California Department of Motor Vehicles (whether licensed or not), designed and equipped to prepare, or serve, and sell food, and temporarily stored in a location where food items are sold to the general public.
PARK: A park, playground, recreation center, tennis courts, swimming facilities, sports field, ball field and/or open space or other area, structure or facility, owned or used by the City and devoted to active or passive recreation, or open for or dedicated to public use within the City of Taft, including, without limitation, those constructed, adapted, or designated as such after adoption of this chapter, and including, but not limited to, that area commonly referred to as "rails to trails" or similar description.
PUBLIC STREET: Shall mean and include, without limitation, streets, roads, highways, alleys, sidewalks, parkways, bridges, culverts, drains, and all other facilities and areas necessary for the construction, improvement and maintenance of streets and roads.
VEHICLE: Any device by which any person or property may be propelled, moved or drawn upon a street, highway, off road or in the water or through the air, including, but not limited to cars, trucks, airplanes, motor homes, recreational vehicles, trailers, watercraft (on or off its hauler) except a device intended to be moved exclusively by human power.
VEND OR VENDING: To sell, offer for sale, display for sale, or solicit offers to purchase food or merchandise, wares, or services. (Ord. 852-23, 7-18-2023)

4-7-3: APPLICABILITY:

This chapter is intended to apply to all mobile food truck and vehicle vending at any locations within the City. However, it does not apply in the following circumstances:

(A) Sidewalk vending described in chapter 22 of title IV of the Taft Municipal Code if all legal requirements therein are met.

(B) Contractual or other private arrangement between a mobile food truck and an individual or group that wishes to have food catered to a specific location on private land and which is not open to the public. (Ord. 852-23, 7-18-2023)

4-7-4: MOBILE VENDING PROHIBITED; PUBLIC NUISANCE:

(A) It shall be unlawful for any person or entity to operate, or allow the operation of, a mobile food truck or vehicle for vending on land within City limits. This prohibition applies to both a person or entity owning or otherwise responsible for the mobile food truck or vehicle and a person or entity owning or otherwise responsible for the land upon which the mobile food truck or vehicle is situated. In no event does this section create liability on part of the City for public lands.

(B) Violation of this section is deemed a public nuisance. (Ord. 852-23, 7-18-2023)

4-7-5: VIOLATIONS AND PENALTIES:

(A) A violation of this chapter is punishable as a misdemeanor or chargeable at the district attorney's or city prosecutor's discretion.

(B) This chapter may also be enforced by Peace Officers of the City of Taft and by the City of Taft employees specified in section 1-1-12 of title I. The enforcement officials provided herein may deem the violation an infraction in their discretion when enforcing this chapter.

(C) Each day in which a violation of this chapter occurs or continues shall constitute a separate and distinct offense and a continuing nuisance. The City may enforce any violation of this chapter pursuant to the nuisance abatement procedures described in chapter 4 of title III of the Taft Municipal Code.

(D) The remedies provided herein are intended to be cumulative and may be utilized in conjunction with or in lieu of other remedies provided by law. Nothing in this section shall be construed to affect, supersede, or otherwise prevent enforcement of provisions under other provisions of the Taft Municipal Code, California State Law, or other law enforceable by the City or to prevent the City from commencing administrative, civil, or criminal proceedings for nuisance abatement, injunctive relief, or other methods of enforcement available under law.
