9.16.010 - Fire in public places prohibited.

No person shall ignite, maintain or make a fire upon any public street or any other public place in the city, except as authorized by the chief of police, fire chief or superintendent of streets.

9.16.020 - Burning—Hours restricted.

No person shall burn any trash, weeds or rubbish or any other material or substance except between the hours of six a.m. and twelve noon of the same day. Training exercises conducted by the fire department are exempt.

9.16.030 - Permitted fires—Restrictions.

A. Any fire ignited, made or maintained under or by virtue of sections 9.16.010 and 9.16.020 shall be extinguished so as to prevent any smoke or odor to arise therefrom by twelve noon of the day the fire was ignited.

B. A person shall not construct, erect, install, maintain or use any fire pit or barbecue pit or so burn any combustible material as to constitute or occasion a fire hazard by the use or burning thereof or as to endanger the life or property of any person thereby.

C. Any fire ignited on private property must be owned or legally controlled by the person igniting the fire or having in his/her possession written permission from the owner or person legally controlling the property.

D. No burning shall be undertaken unless weather conditions (particularly the wind) are such that they can reasonably be considered safe (less than fifteen miles per hour during burning period).

9.16.040 - Violation—Penalty.

Any person violating any of the preceding sections is guilty of a misdemeanor or infraction, and upon conviction shall be punished by imprisonment in the county jail for not more than six months, or by fine not exceeding one thousand dollars or by both.
