2.36.010 - Cemetery designated.¶
The tract of land described in this section, situated in the City of Sutter Creek, Amador County, California, is designated as the Sutter Creek Public Cemetery:
Lot No. 10 in Block No. 23 as designated on the official plat of the city, containing one and fifty-four one hundredths acres, and commonly known as the "Old Cemetery";
Also a portion of the eastern part of Lot No. 12 in Block No. 23, bounded on the west by the Catholic Cemetery; on the north, by lands of George Allen; on the east, by the above described "Old Cemetery" and on the south, by the I.O.O.F. Cemetery, containing one acre, more or less;
Also any additional land that may be purchased or acquired by the city for cemetery purposes.

2.36.030 - Burial lots—Charges.¶
The prices to be charged for burial lots of various sizes, and the charge to be made for the digging of graves in the cemetery, shall be determined by the city council; the council may also, at its discretion, fix an annual charge to be paid by the owners of burial lots for caring for and keeping such lots in order, all funds received by the city on account of the cemetery to be deposited in the city treasury and placed in the cemetery fund.

2.36.040 - Improvements.¶
No improvements of any character will be permitted in the cemetery unless the full purchase price of the lot on which the improvements are to be made has been paid to the city. All improvements are subject to the inspection and approval of the city. Before any improvements can be commenced or made, a copy of the contract and a sketch or blueprint of such improvements must be filed with the city clerk and the approval of the city thereon obtained.

2.36.050 - Burial lots—Sale.¶
The city council and the city clerk are authorized to execute all necessary conveyances on behalf of the city for the sale of any burial lots in the cemetery.

2.36.060 - Offenses of cemetery regulations.¶
It is unlawful and a misdemeanor:
A. To bury in the cemetery or to remove therefrom for burial or other purpose the body of any deceased person without first having obtained permission to do so from the city;
B. To violate or refuse, fail or neglect to comply with any lawful general or special order, notice or direction of the city or the city council relating to the cemetery;
C. For any person other than city personnel, to dig any grave in the cemetery, without first having obtained permission from the city to do so;
D. To in any way damage the trees, floral beds, monuments, headstones or improvements of any kind in any part of the cemetery, or to act in any way in a disorderly manner, pilfering or vandalism of any sort being strictly prohibited;
E. To bury in the cemetery the remains of any person whose death has occurred from any disease held by the State Board of Health to be infectious, contagious, communicable and dangerous to the public health, unless same is buried in a sealed metallic casket or a cemented grave, in accordance with state laws;
F. To leave or deposit rubbish, dirt, brush or refuse of any kind on graves, walks or passageways in the cemetery or at any place therein other than dumping ground selected by the city, or to build fires for any purpose in the cemetery without permission of the city, or at any place therein that is not selected by the city.

2.36.070 - Violation—Penalty.¶
The penalty for violations of this chapter shall be as prescribed in section 1.16.010.
