9.12.010 - Incineration—Conditions.

No person shall burn any combustible waste matter in any incinerator upon any property unless the following requirements are complied with:

A. The area immediately adjacent to the exterior of the incinerator is maintained free and clear of all combustible waste matter and vegetation for a distance of ten feet;

B. An adequate water supply or other sufficient fire extinguishing equipment is located immediately adjacent to the exterior of the incinerator used, and a person capable and competent to extinguish fires is present at all times when an incinerator is in use;

C. All openings to incinerators must be screened with a noncombustible material not larger than one-fourth-inch mesh;

D. Residential incinerators shall be constructed of brick, concrete, metal or other fire-resistive material;

E. Residential incinerators used in connection with a single-family dwelling shall be located not less than fifteen feet form any wood-frame building or structure; and

F. Commercial and industrial type incinerators when permitted shall be constructed in accordance with the provisions of the building and mechanical codes.

9.12.020 - Combustible waste matter defined.

Combustible waste matter shall mean magazines, books, trimmings from lawns, trees, flower gardens, pasteboard boxes, rags, paper, straw, sawdust, packing material, shavings, boxes and all rubbish and refuse that will ignite through contact with flames of ordinary temperature.

9.12.030 - Incinerator defined.

For the purpose of this chapter, an incinerator means any device constructed of noncombustible materials for the purpose of burning combustible waste matter.

9.12.035 - Noncombustible defined.

For the purpose of this chapter, noncombustible means building construction or other material of which no part or portion will ignite and burn under any circumstances.

9.12.040 - Violation—Penalty.

Any person, firm or corporation violating the provisions of this chapter is guilty of a misdemeanor or infraction, and upon conviction shall be punishable by a fine not exceeding one thousand dollars or by imprisonment for not more than six months in the county jail, or by such fine and imprisonment.
