790-010 - PURPOSE AND FINDINGS¶
Sutter County constructed the Stonegate Village Sewage-Treatment plant to serve properties within the Tierra Buena Community Services District. Construction was financed by using improvement bonds, which will be repaid from assessments on properties within the Stonegate Village Subdivision. This ordinance establishes a hookup fee to be charged to, and paid by, properties outside the Stonegate Village Subdivision that hook up to the treatment plant. The Board of Supervisors finds that the hookup fee is needed to collect funds from properties outside the Stonegate Village Subdivision so that all properties served by the treatment plant bear an equal share of the cost to construct it.

790-020 - AUTHORITY¶
This ordinance is authorized by Government Code section 25825 and Health and Safety Code section 5471.
790-030 - AREAS OF APPLICATION¶
This ordinance shall apply only to properties within the Tierra Buena Community Services District that hook up to the treatment plant, are outside the Stonegate Village Subdivision, and are not entitled to use sewage capacity allocated to a lot within Stonegate Village Subdivision.
790-040 - FEE SCHEDULE¶
A hookup fee of five thousand forty-three dollars ($5,043.00) shall be charged to the owner or owners of each property that hooks up to the treatment plant.
790-050 - USE OF FEE REVENUES¶
Revenues generated by the fee shall be used only to redeem a portion of the improvement bonds issued to finance construction of the treatment plant.
790-060 - COLLECTION OF FEE¶
The hookup fee shall be payable as properties are hooked up to the plant, and the Sutter County Development Services Department shall bill the owners of those properties.
