415-010 - DEFINITIONS

When used in this ordinance [chapter] the following words and phrases shall have the following meaning:

CARD ROOM: Any place where games of cards are played.

DANCE HALLS: Any public place where dances are held or where dancing is permitted as a means of entertainment.

HARD LIQUOR: Any Beverage containing more than one-half of 1% of alcohol by volume.

HARD LIQUOR STORE: Any place where hard liquors are kept, stored, sold or handled.

POOL HALL: Any place of business having pool or billiard tables where games of pool or billiards or similar games are played.

ROAD HOUSE: Any place where dancing or other amusement is permitted with the serving of meals, or between courses of meals or before or after meals or where any other entertainment is permitted or allowed during meals.

SOFT DRINKS: Any beverage, whether in the original package or bottled or whether mixed at any place of business, which beverage contains less than one-half of 1% of alcohol by volume.

SOFT DRINK STORE: Any place where soft drinks are sold, mixed or handled.

415-020 - CLOSING HOURS

Except for a business operated under a license issued pursuant to Chapter 3, Division 9 of the California Business and Professions Code commencing at § 23300, all places of business commonly known as pool halls, card rooms, road houses, dance halls, and all businesses of a similar kind or nature conducted within the unincorporated limits of the County of Sutter, shall close and remain closed from the doing of all business of every kind or nature between the hours of 2:00 a.m. and 6:00 a.m.

415-030 - PROHIBITED ACTIVITIES

It shall be unlawful for any person as owner, agent, operator or employee, or any other person in charge of any of the businesses described in Section 415-020 hereof, during the time said businesses should be closed under the terms of Section 415-020 of this Chapter, to allow or permit said place of business under his or her control to remain open for business as owner, agent, operator or employee to remain in said place of business, or to allow or permit any person to enter said place of business, or to allow or permit any person to engage in any pool game, card game or dance in said place of business.

415-040 - PENALTY

Any person violating any of the provisions of this Ordinance shall be guilty of a misdemeanor and upon conviction therefor shall be subject to a fine of not more than five hundred dollars ($500.00) or imprisonment in the County Jail not more than six months, or by both such fine and imprisonment.
