1120-010 - VEHICLES AND EQUIPMENT DEFINED

For the purposes of this chapter vehicles and equipment are defined as those set forth in sections 100 through 680 inclusive of the Vehicle Code of the State of California as amended.

1120-020 - PROHIBITED STOPPING, STANDING, OR PARKING

No person shall stop, park, or leave standing any vehicle whether attended or unattended, except when necessary to avoid conflict with other traffic or in compliance with the directions of a peace officer or official traffic control device, in any of the places listed in sections 22500 and 22500.1 of the Vehicle Code of the State of California as amended.

1120-030 - SCHOOL BUS PARKING

School buses owned or operated under contract for any public school district within Sutter County are permitted to stop for the loading or unloading of passengers alongside any or all curb spaces designated for the loading or unloading of passengers of the Yuba Sutter Transit Authority.

1120-040 - UNREGISTERED VEHICLES

No person shall leave standing on any County street, highway, or public parking facility any vehicle as defined in division 1 of the Vehicle Code of the State of California requiring registration, unless it is registered, and proof of such valid registration is properly displayed, in compliance with the Vehicle Code.

1120-050 - DISPLAY OF LICENSE PLATES

No person shall leave standing on any County street, highway, or public parking facility any vehicle as defined in division 1 of the Vehicle Code of the State of California requiring registration, without proper display of license plates, as defined in section 5200 of the Vehicle Code.

1120-060 - PARKING FOR CERTAIN PURPOSES PROHIBITED

No person shall park a vehicle upon any roadway for the principal purpose of:

(a) Displaying such vehicle for sale.

(b) Repairing such vehicle, except repairs necessitated by an emergency for a period not to exceed 24 hours.

1120-070 - PROHIBITED PARKING—PEDDLERS, VENDORS

(a) Except as otherwise provided in this section, no person shall stand or park any vehicle, wagon or pushcart from which goods, wares, merchandise or food are sold, displayed, solicited or offered for sale or barter or exchanged, or any lunch wagon or eating car or vehicle, on any portion of any street or highway within this County except that such vehicles, wagons, or pushcarts may stand or park only at the request of a bona fide purchaser for a period of time not to exceed ten minutes at any one place. The provisions of this subsection shall not apply to persons delivering such articles upon order of, or by agreement with a customer from a store or other fixed place of business or distribution.

(b) No person shall park or stand on any street any lunch wagon, eating cart or vehicle, or pushcart from which articles of food are sold or offered for sale without first obtaining a written permit to do so from the Sheriff's Department, which shall designate the specific location(s) in which such cart shall stand.

(c) Whenever any permit is granted under the provisions of this chapter and a particular location to park or stand is specified therein, no person shall park or stand any vehicle, wagon, or pushcart on any other location other than designated in the permit. If the holder of any such permit receives a notice of parking violation for violating this section and:

(1) Does not contest the violation; or

(2) Unsuccessfully contests the violation, such that an administrative or judicial determination that the holder committed the violation becomes final;

Then the Sheriff's Department shall revoke the permit forthwith, and no permit shall thereafter be issued to such person until six months have elapsed from the date of such revocation.

1120-080 - DISABLED PERSON PARKING

No person shall park or leave standing any vehicle in any stall or space designated for disabled persons and disabled veterans in accordance with sections 22511.7 and 22511.8 of the Vehicle Code of the State of California, unless the vehicle displays a special identification license plate issued pursuant to section 5007 of the Vehicle Code or a distinguishing placard issued pursuant to section 22511.55 or 22511.59 of the same code.

(a) No person shall obstruct, block, or otherwise bar access to those parking stalls or spaces, except as provided above.

(b) No person shall park or leave standing any vehicle, including a vehicle displaying a special identification license plate pursuant to section 22511.55 or 22511.59, in either of the following places:

(1) On the lines marking the boundaries of a parking stall or space designated for disabled persons or disabled veterans.

(2) In any area of the pavement within a parking lot or parking facility that is marked by crosshatched lines and is thereby designated for the loading and unloading of vehicles pursuant to any local ordinance.

(c) The provisions of this section apply to all off-street parking facilities owned or operated by the State, to all off-street parking facilities owned and operated by a local authority, and to any privately owned and maintained off-street parking facility.

1120-090 - ANGLE PARKING

(a) Specified areas of certain streets and roadways in the County of Sutter, as hereinafter designated in this section, are hereby established for angle or diagonal parking. Such diagonal parking shall be at an angle of 45 degrees to the curb or gutter line for all vehicles providing however, that in no case shall vehicles exceeding 25 feet in over-all length be parked in said areas, except as hereinafter provided, and that in no case shall any vehicle be parked so as to block the through traffic, or so as to block means of ingress and egress to and from said roadways.

(b) Any delivery vehicle, whether or not the same exceeds 25 in over-all length, may park in any reasonable manner and for any reasonable period of time within the areas herein designated for the purpose of loading or unloading any goods whatsoever to or from any business, building, or place within the areas herein specified. So long as such delivery vehicle is parked in such reasonable manner and for such reasonable period of time, no such delivery vehicle shall be deemed to be parked in violation of this section.

(c) In accordance with and subject to the limitations set forth in subsection (a), diagonal parking shall be authorized within the areas specified in subsection (e) of this section on the following streets and roadways:

(1) In the Community of Sutter:

a. California Street from south Butte Road to Butte House Road.

b. Nelson Street from Madrone Street to Palm Street.

c. Acacia Street from Butte House Road to Marshall Avenue.

d. South Butte Road from Acacia Street to Madrone Street.

e. Butte House Road from Acacia Street to Madrone Street.

f. Madrone Street from Butte House Road to College Avenue.

g. Lyon Street from California Street to Pepper Street.

h. Pepper Street from South Butte Road to Nelson Street.

i. North Butte Road from Everett Street to Oak Street.

j. Barrow Street from California Street to Pepper Street.

(2) In the Community of Meridian:

a. First Street from D Street to Bridge Street.

b. Fourth Street from D Street to Bridge Street.

c. Bridge Street from First Street to Fifth Street.

(3) In the Community of East Nicolaus:

a. Nicolaus Avenue from Willow Street to Sacramento Northern Railway.

b. Palm Street from Sutter Street to Nicolaus Avenue.

(4) In the community of Nicolaus:

a. Garden Highway and Nicolaus Avenue from Markham Road to a point 0.2 miles south of Markham Road.

(d) The provisions of this section shall not be effective until appropriate signs giving notice that diagonal parking is permitted on the above listed areas of roadways are erected.

(e) It is hereby made the duty of the Road Commissioner to erect and maintain appropriate signs giving notice of the permissibility of said diagonal parking. Said signs shall be placed as required to designate said diagonal parking within the areas and on the streets and roadways hereinbefore described before schools, churches, public buildings, commercial buildings and stores, commercial areas, public meeting places, and other buildings, halls, or places open to the public. Said signs shall be erected at the discretion of the Road Commissioner and in a manner not dangerous to public safety.

1120-100 - PROHIBITED OR RESTRICTED PARKING ON CERTAIN STREETS OR PORTIONS THEREOF

In accordance with section 22507 of the Vehicle Code of the State of California the Board of Supervisors may determine the necessity of prohibiting or restricting parking or standing of vehicles on certain portions of County roadways. The portions of County roadways for which standing or parking is prohibited or restricted shall be established by resolution. The provisions of this section shall not be effective until appropriate signs giving notice that parking is prohibited or restricted are erected on those certain portions of streets. In lieu of signs, curb markings in accordance with section 21458 of the Vehicle Code of the State of California may be used.

It is hereby made the duty of the County Road Commissioner to erect and maintain appropriate signs or install proper curb markings giving notice of the areas of prohibited or restricted parking.

1120-105 - PARKING IN COUNTY PARKING LOTS

(a) Any parking lot, driveway, roadway, or part thereof, located on county-owned property may be designated by the Board of Supervisors as a restricted parking area. The Board of Supervisors may regulate or restrict the parking of motor vehicles in restricted parking lots by requiring permits for parking, setting time limits on parking, designating certain parking spaces for certain individuals or certain types of individuals, or by any other means whatsoever.

(b) The Board of Supervisors hereby delegates to the General Services Director the authority to restrict parking on County property and confers upon the General Services Director, the duty to erect and maintain appropriate signs or install proper curb markings giving notice of the areas of prohibited or restricted parking and providing notice that vehicles parked in violation thereof shall be subject to removal pursuant to Section 22651(n) of the California Vehicle Code.

(c) Every parking area, driveway, roadway, or part thereof, subject to regulation shall be clearly marked as to the restrictions imposed and shall have a sign posted at every entrance and exit stating that the lot is a restricted parking lot and stating the restrictions on parking that have been imposed. In lieu of signs, curb markings in accordance with section 21458 of the Vehicle Code of the State of California may be used.

(d) When lines have been painted onto a parking area, driveway, roadway, or part thereof, which designate individual spaces for the parking of vehicles, all vehicles shall be parked within those designated spaces so as to not encroach upon any other designated space. There shall be no parking in areas not designated for parking or on grassy areas surrounding county owned buildings, unless specifically authorized by the General Services Director.

(e) It shall be unlawful for any persons to park a motor vehicle of any kind on any county-owned property in violation of this Ordinance, when so designated by sign, or to leave any vehicle unattended blocking another motor vehicle legally parked, or to improperly park a motor vehicle on county-owned property not designated for use as a parking space.

(f) Reserved.

(g) It is the intent of this Ordinance that clearly marking and posting the restrictions on any lots or parking spaces fulfills all of the requirements of this Ordinance and constitutes notice to all individuals to be noticed of these restrictions as applying to those lots or spaces so marked.

(h) Pursuant to the provisions Section 22651 of the California Vehicle Code, vehicles parked in violation of this Ordinance may be cited and/or removed from the property by the County or an agent of the County to a storage area or garage. If a vehicle is so removed, the owner, as a condition of regaining possession of the vehicle, shall be required to pay to the County all reasonable costs incidental to the removal and storage of the vehicle and any fine or penalty due for the violation.

1120-110 - VIOLATIONS—CIVIL PARKING PENALTIES

Any person, firm or corporation who violates any provisions of this Chapter shall be subject to a civil parking penalty for each violation in amounts not exceeding the amounts specified below.

1120-120 - REMOVAL OF CERTAIN VEHICLES FROM ROADWAYS

No person shall allow or permit any vehicle to remain standing or parked on any County street, roadway, or alley for a period in excess of 120 hours. Any such vehicle so standing or parked may be removed in accordance with terms and conditions of chapter 10 of division 11 of the Vehicle Code of the State of California.

1120-130 - VEHICLE REMOVAL; LOCATION; PRIVATE SALE ADVERTISEMENT

Any vehicle found upon a street or public lands in unincorporated areas of Sutter County that meets all the requirements specified in section 22651 of the Vehicle Code of the State of California may be removed pursuant to said section by any peace officer as defined in Chapter 4.5 of Title 3 of Part 2 of the Penal Code.
