Suisun City Municipal Code Art. IX Wells

Subject to the modifications and amendments set forth in this article, Solano County Ordinance Number 1348 is adopted and incorporated into the codes of Suisun City by reference and as having the legal effect as if it contents were set forth in this article and which may be corrected or amended from time to time. A copy of Solano County Ordinance Number 1348 shall be maintained in the files of the Suisun City clerk and in the officer of the director of public works.

The Solano County department of environmental management, division of environmental health or any sucessor agency to it is authorized to undertake the inspections and other activities encompassed within this article and to enforce the provisions of this article within the corporate limits of Suisun City.

Resolution 89-179 adopted by the Solano County board of supervisors on September 5, 1989, and which sets the fees established in Solano County Ordinance No. 1348 is adopted and incorporated into the codes of Suisun City by reference and as having the legal effect as if its contents were set forth in this article and which may be corrected or amended from time to time. A copy of Solano County Resolution Number 89-179 shall be maintained in the files of the city clerk and in the office of the director of public works. Such fees and charges shall apply to any person, firm or coporation subject to the provisions of this article.

The definition of "person" found in Section 13.10.101 of Ordinance 1348 is amended to read as follows:

Person shall mean any individual, firm, partnership, general corporation, association or governmental entity. "Governmental entity," as used herein, shall not include the City of Suisun City, an irrigation district, nor any local agency exempt from the application of the Ordinance pursuant to state law, and shall include the United States to the extent authorized by federal law.

The third sentence of Section 13.10.104(a) of Ordinance 1348 is amended to read as follows:

Water wells may be located in public utility easements, provided that written permission is obtained from the utility.
