5.04.010 - Purpose.

The ordinance codified in this chapter is enacted solely to raise revenue for municipal purposes, and is not intended for regulation.

5.04.020 - Definitions.

For the purpose of this chapter, unless it is plainly evident from the context that a different meaning is intended, the words and phrases used in this chapter shall have the meanings set forth as follows:

A. "Business" includes professions, trades and occupations and all and every kind of calling, whether or not carried on for profit.

B. "Collector" means the city or the agent of the city, their deputies, assistants, agents or any other city officer charged by the city manager with the administration of this chapter.

C. "Fixed place of business" means the premises occupied in the city for the particular purpose of conducting a business thereat and regularly kept open for that purpose with a person in attendance for the purpose of attending to the business.

D. "Newly established business" means a business in existence and operation for less than three months.

E. "Person" includes all domestic and foreign corporations, associations, syndicates, joint stock corporations, partnerships of every kind, clubs, business or common law trusts, societies, and individuals transacting and carrying on any business in the city other than as an employee.

F. "Sale" includes the transfer, in any manner or by any means whatsoever, of title to property for a consideration; the serving, supplying or furnishing for a consideration of any property; and a transaction whereby the possession of property is transferred and the seller retains the title as security for the payment of the price shall likewise be deemed a "sale." The definitions set out in this subsection shall not be deemed to exclude any transaction which, in effect, results in a sale within the contemplation of law.

G. "Vehicle" means every device in, upon or by which any person or property is or may be transported or drawn upon a public street or highway, except devices moved by human power or used exclusively upon stationary rails or tracks.

H. "Gross receipts" means the total amount actually received or receivable for goods and services.

I. "City" means city of Suisun City, Suisun City Redevelopment Agency, and their officers, officials, employees and volunteers.

J. "Peddler" means any person who sells and makes immediate delivery or offers for sale and immediate delivery, any goods, wares, merchandise or thing from a vehicle or other than at a fixed place of business. This definition shall not include salesmen or agents for wholesale houses or firms who sell to retail dealers for resale or sell to manufacturers for manufacturing purposes, to bidders for public works projects, supplies or similar persons.

K. "Peddler cart" means a mobile cart from which beverages and/or ready-to-eat food items or any other merchandise are sold. Such a cart is not intended to remain at any one location for more than thirty minutes.

L. "Vendor" means a person who sells, or offers to sell, any type of merchandise at any fixed location other than a building or structure constructed on a permanent foundation which is rented, leased or owned by that person. Vendors are distinguished from peddlers, who typically move from place to place.

M. "Vendor carts" are self-contained, temporary or mobile units for the sale of beverages, food items and/or general merchandise from a fixed location.

N. "Vending" means selling or offering to sell, any type of merchandise at any location other than a building or structure constructed on a permanent foundation which is rented, leased or owned by the person selling or offering to sell the merchandise.
