§ 12.24.010. Dedication requirement.

A. No building or structure shall be erected, modified or enlarged, and no building permit shall be issued therefor on any lot in any zone, unless one-half of the street upon which the lot abuts has been dedicated and improved for the full width of the lot so as to meet the standards for such street in accordance with the standards for the street as are on file with the city engineer.

B. The maximum area of land to be so dedicated shall not exceed twenty-five percent of the area of any such lot which was a lot of record as of the effective date of the ordinance codified herein. In no event shall such dedication reduce the lot below a width of fifty feet or an area of five thousand square feet.

C. No such dedication shall be required with respect to those portions of such a lot occupied by a main building as of the effective date of the ordinance codified herein.

§ 12.24.020. Improvement.

Any person required to make improvements under this chapter shall either make and complete the same to the satisfaction of the city engineer or shall file a cash, surety bond or other acceptable surety device or agreement acceptable to the city engineer and the city attorney.

§ 12.24.030. Improvement standards.

The city council shall by resolution establish from time to time the standards for improvement required for each street within the city, together with the required width thereof, and the city engineer shall keep the same on file in his office and available for public inspection.

§ 12.24.040. Appeal.

A. Any person required to dedicate land or to make improvements by the provisions of this chapter may seek relief for deviation from the requirements by filing an appeal in writing to the planning commission of the city.

B. If the applicant is not satisfied with the determination of the planning commission, he may seek a review of such determination by filing a written appeal with the city council. The decision of the city council shall be final.

C. The planning commission and/or the city council may make such modifications to the requirements of this chapter or may grant such waivers or modifications which are appealed to them as they shall determine are required to prevent any unreasonable hardship under the facts of each case so long as each such modification or waiver is in conformity with the general spirit and intent of the requirements of this chapter.

§ 12.24.050. City may share costs.

Upon proper application to the city council and upon recommendation of the city engineer, the city may accept and provide for contribution toward the cost of making any improvement required by the provisions of this chapter which the city engineer determines will cost an amount greatly in excess of the cost to other property owners who are required to make improvements under the provisions of this chapter in the immediate vicinity of the improvement.

§ 12.24.060. Construction.

Whenever uncertainty exists as to the proper application of the provisions of this chapter in the matter of street alignment, the city engineer shall determine their application in conformity with the spirit and intent of this chapter.
