§ 17.04.010. Purpose.

It is the purpose of this title to prevent obstructions to navigation in the vicinity of airports. This title regulates and restricts the height of structures and objects of natural growth, and otherwise regulates the use of property in the vicinity of the Modesto City-County Airport/Harry Sham Field, Oakdale Municipal Airport, Patterson Airport and Turlock Airpark.

§ 17.04.020. Determination of height limiting area.

Whenever a question arises on determining the location of a height limiting area, the director of planning and community development shall make a decision concerning the location.

§ 17.04.030. Administration and enforcement.

The director of planning is designated the administrative officer charged with the duty of administering and enforcing the regulations prescribed in this title. The duties of the director of planning shall include that of hearing and deciding all permits under Section 17.04.020, but the director of planning shall not have or exercise any of the powers or duties delegated in this title to the board of supervisors.

§ 17.04.040. Appeal.

If the applicant or property owner is not satisfied with the decision of the director of planning and community development rendered pursuant to Section 17.04.020, the applicant or property owner may appeal the decision within ten days to the planning commission as prescribed in Chapter 17.24.
