§ 9.08.150. Open containers adjacent to off-sale beverage sales locations.¶
No person having in his or her possession any bottle, can or other receptacle containing any alcoholic beverage which has been opened, or the seal broken, or the contents of which have been partially removed shall enter, become or remain on the premises, including any immediately adjacent parking area or public sidewalk of any retail package off-sale alcoholic beverage licensee licensed pursuant to Division 9 (commencing with Section 23000) of the Business and Professions Code. The provisions of this section will apply to locations where the prohibitions of this section are posted and visible to persons utilizing the establishment and adjacent parking lot public sidewalk.

§ 9.08.160. Notices to be posted adjacent to off-sale beverage sales locations.¶
Every person operating in a retail package off-sale beverage establishment within the city licensed pursuant to Division 9 (commencing with Section 23000) of the Business and Professions Code shall post a notice or notices visible to the patrons of such establishment and persons utilizing the adjacent parking area and public sidewalk informing them that it is unlawful for any person having in his or her possession a bottle, can or other receptacle containing any alcoholic beverage which has been opened, or a seal broken, or the contents of which have been partially removed to enter, be, or remain on the premises of the establishment and adjacent parking area and public sidewalk.

§ 9.08.170. Violation of Sections 9.08.150 and 9.08.160.¶
Violation of Section 9.08.150 shall constitute an infraction and violation of Section 9.08.160 shall constitute a misdemeanor and shall be punishable as provided in Section 1.16.010 of this Code.

§ 9.08.180. Consumption of alcoholic beverages in public.¶
Every person who goes upon or remains upon any part of a public street, alley or way while he or she is consuming an alcoholic beverage is guilty of a misdemeanor.

§ 9.08.190. Public drunkenness.¶
It is unlawful for any person to be found drunk, intoxicated or under the influence of intoxicating liquor upon any public thoroughfare or other public place.
