Article XIV — Advisory Board on Drug Programs.

Sec. 2-142. - Composition of the board; manner of appointment of members; vacancies.

The board shall be composed of the following members:

(1)

Fifteen (15) members, who are to be appointed for a term of three (3) years, staggered so that the terms of approximately ⅓ of the members expire each year.

(2)

At least two (2) members from each supervisorial district to be appointed by the board of supervisors; the remaining five (5) members to be appointed by the board of supervisors need not come from any particular district. Members shall have a professional interest in, or personal commitment to, alleviating drug abuse in their community. The membership shall include representatives from various economic, social and occupational groups and shall be broadly representative of the demographic characteristics of the county and shall contain members meeting the requirements of Penal Code section l3862(a)(4).

The board shall be independent from any other advisory body established pursuant to any provision of state law. However, the board shall coordinate its efforts, where appropriate, with other county advisory bodies concerned with drug problems.

The board shall not include in its membership any person, or his or her spouse, who is any of the following:

(a)

A member of a board of directors or advisory body or employee of any county or city operated or county or city contract provider of drug services in receipt of drug program funds from the State.

(b)

A direct recipient of any state drug abuse funds pursuant to a contract with the State, which shall include compensation for contracted services or membership on an advisory body or board of directors of such recipient agency.

(c)

A member of the board of supervisors or a person on the staff of a member of the board of supervisors.

(d)

An employee of the County Department of Mental Health Services; provided, however, that pursuant to Penal Code section 13862(a)(4), the County Drug Program Administrator shall become an additional 16th member whenever a matter comes before the board requiring review by a committee where the County Drug

Program Administrator is required by law to be a member. Except for such cases, the County Drug Program Administrator shall not be a member of the Drug Abuse Advisory board.
