Chapter 8 — MUNICIPAL PURCHASES AND CONTRACTS

§ 1-8-1. System established.¶
The City Council shall by resolution establish a purchasing system in order to provide efficient procedures for the purchase of supplies and equipment; to secure supplies and equipment at the lowest possible cost commensurate with quality needed; to exercise positive financial control over purchases and to define authority for the purchasing function.
Notwithstanding the foregoing, all public works contracts in excess of $1,000 shall contain a requirement that the contractor pay prevailing wages and otherwise comply with Labor Code Section 1770 et seq.

§ 1-8-2. Designation of purchasing functions.¶
The city manager is assigned overall purchasing responsibilities for all the departments and divisions of the city. To discharge these responsibilities, the city manager may designate such other person or persons, as he or she deems necessary to ensure compliance with the laws, rules and regulations governing the purchasing of supplies and equipment. § 1-8-3. Purchasing officer duties.¶
The position of purchasing officer shall be the director of administrative services unless otherwise specified by the city manager. The purchasing officer shall have the general supervision and responsibility for the purchasing of supplies and equipment and shall utilize resources within the
departments to comply with the specified duties. The duties of the purchasing officer may be combined with those of another officer or position. (Ord. 14-310, 2015)
§ 1-8-4. Noncompliant contracts void.¶
No officer (including elected officials) or employee of the city shall have the power to enter into a contract on behalf of the city of Solvang except in conformance with this code and in conformance with a purchasing resolution duly adopted by the city council. Any contract executed by an officer (including elected officials) or employee without the express approval of the city council given at a duly noticed meeting is void.
