3.28.010 - Inapplicability to certain claims.

The provisions of this chapter do not apply to those claims where the time, manner and conditions of presentation are otherwise provided for by the Tort Claims Act (as set forth in Chapter 2, Division 3.6, Title 1 of the California Government Code, commencing with Section 910), or by any other applicable state law.

3.28.020 - Form of claim.

A claim against the city must be in writing and must contain a general description of the transaction giving rise thereto, the date of the transaction, and an itemized statement of the amount claimed to be due. It must be dated and signed by the claimant, and the post office address of the claimant must be shown on the statement.

3.28.030 - Presentation.

Claims shall be filed with the city clerk and shall be presented to the city council at its next regular meeting.

3.28.040 - Approval or rejection of claim.

If the city council finds that a claim is a proper charge against the city, it shall approve the claim for payment. If it finds that the claim is not a proper charge, it shall reject the claim and the claimant shall be given written notification of the rejection.

3.28.050 - Payment.

Upon the approval of a claim by the city council, a warrant for the amount allowed shall be issued and delivered to the claimant in return for a receipt from the claimant acknowledging full payment of the account.
