2.12.010 - Planning agency established.

Pursuant to the provisions of Section 65100 of the Government Code of California, a planning agency is established for the city, consisting of a planning commission and a planning department.

2.12.020 - Planning commission.

A. The planning commission shall consist of five members. At least four of the commission's members shall be residents of the city, and the office shall become vacant when he or she ceases to be a resident of the city. The fifth "at-large" commissioner may be appointed from those individuals residing within the city's sphere of influence, as designated in the most current version of the Soledad general plan. The office of the at-large commissioner shall become vacant when she or he ceases to reside within the city's sphere of influence. Notwithstanding this provision, nothing shall prevent the council from filling the at-large commission seat with a resident from the city if no at-large applicant is available or deemed acceptable. Members shall be appointed by the mayor with the approval of the city council.

B. Commissioners shall serve terms of four years and may be reappointed pursuant to subsection A of this section. This section shall be implemented through attrition, but no later than April, 1994.

2.12.021 - Planning commission eligibility requirements.

The minimum requirements for appointment to the Soledad planning commission shall be as follows:

A. Be a resident of the city of Soledad except as provided in Section 2.12.020A;

B. Be a minimum of eighteen years of age;

C. Be a registered voter.

2.12.025 - Removal of member for failure to attend.

If a planning commission member absents himself or herself from more than three regular meetings of the commission during any calendar year, then regardless of any excuse for such absences, the city council may by resolution remove such member from office. The vacancy created by such removal shall be filled by appointment as provided in Section 2.12.020, and the person appointed shall serve for the remainder of the term of the removed member.

2.12.030 - Planning department.

The planning department shall consist of a planning director and such other employees as the city council from time to time deems necessary. The planning director shall also serve as zoning administrator, and as such has all of the powers and duties set forth in Section 65091 of the Government Code.

2.12.040 - Functions, powers and duties.

The functions, powers and duties of the planning agency shall be as set forth in Sections 65101, 65102 and 65103 of the Government Code.
