Sec. 5-5.01. - Purposes.

The declared purposes of this chapter are to provide minimum procedures for the proper construction, maintenance, and operation of food facilities within the County.

Sec. 5-5.02. - Standards.

Standards for the construction, repair, remodeling, maintenance, and operation of food facilities within the County shall be as specified in the California Uniform Retail Food Facilities Law, commencing with Section 27500, Chapter 4 of Division 22 of the Health and Safety Code of the State.

Sec. 5-5.03. - Permit fees.

Food facility permits, as required by this chapter, shall be subject to annual fees commencing on January 1 of each calendar year or for the unexpired portion of the calendar year in which the application is made.

Food facility permit fees, as adopted by the Board, shall be nonrefundable and nontransferable.

The permit fees shall be listed in Section III of Table 5-7.01 of Chapter 7 of this title regarding Public Health Department fees to be charged.

Sec. 5-5.04. - Violations: Penalties.

Any person who violates any provision of this chapter or regulation adopted pursuant to this chapter shall be guilty of a misdemeanor. Each offense shall be punished by a fine of not less than Twenty-Five and no/100ths ($25.00) Dollars or more than One Thousand and no/100ths ($1000.00) Dollars, or by imprisonment in the County Jail for a term not exceeding six (6) months, or by both such fine and imprisonment.

The owner, manager, or operator of any food facility shall be responsible for any violation by an employee of any provision of this chapter. Each day any violation occurs shall be a separate and distinct offense.
