Sec. 6-6.01. - Title.

This chapter shall be known as the "Tattooing Permit Law of the County of Siskiyou".

Sec. 6-6.02. - Definitions.

For the purposes of this chapter, unless otherwise apparent from the context, certain words and phrases used in this chapter are defined as follows:

(a) "Director of Public Health" shall mean and include the Director of Public Health, his assistant, or any regularly qualified employee or inspector of the Department of Public Health.

(b) "Tattooing" shall mean any method of placing designs, letters, scrolls, figures, symbols, or any other marks upon or under the skin with ink or colors by the aid of needles or instruments.

(c) "Person" shall mean any individual, firm, corporation, owner, or operator of a tattooing establishment.

Sec. 6-6.03. - Permits.

It shall be unlawful for any person, firm, or corporation owning, controlling, leasing, acting as agent for, conducting, managing, or operating any establishment to practice the art of tattooing or to engage in the practice of tattooing without first applying for and receiving a permit from the Director of Public Health in the manner provided in this chapter.

Every applicant for such permit shall file with the Department of Public Health a written application which shall state the name and address of the applicant, a description of the property, by street and number, wherein and whereon it is proposed to conduct the tattooing establishment, a description of the experience of and qualifications of each person engaged in the practice of tattooing, and such other pertinent information as the Department of Public Health may require.

Permit fees established for the regulation of this chapter shall be listed in Section IV of Table 5-7.01 of Chapter 7 of Title 5 of this Code relating to fees charged for public health services.

Sec. 6-6.04. - Investigations and inspections.

It shall be the duty of the Director of Public Health to investigate the statements made in the application, and the premises where it is proposed to practice the business of tattooing, and if it shall appear to the Director of Public Health that the statements contained in the application are true, and that the sanitary conditions prevailing upon the premises comply with the provisions of this chapter and the State laws and conform to the rules and regulations of the Director of Public Health, a permit therefor shall be granted for the establishment. Such permit shall be granted only upon the express condition that the permit shall be subject to suspension or revocation by the Director of Public Health upon a showing satisfactory to him of a violation by the holder of such permit, or person or employee acting with his consent or under his authority, of any provision of this chapter, or any law of the State, or any rule or regulation of the Director of Public Health regulating tattooing establishments, which rules and regulations the Director of Public Health is hereby authorized to make.

Sec. 6-6.05. - License fees.

Every person engaged in the business of conducting, managing, or operating any establishment for the practice of the art of tattooing shall pay a license fee each year, or any portion of a year, payable annually in advance to the Tax Collector and Treasurer.

Sec. 6-6.06. - Qualifications of operators.

It shall be unlawful for any person to employ an operator in the practice of tattooing without such operator having first secured an operator's card. The issuance of the operator's card provided for in this section shall be subject to the applicant's compliance with the regulations and passage of the physical examination required by the rules and regulations of the Director of Public Health. An operator's card shall be granted only on the express condition that the card shall be subject to suspension or revocation by the Director of Public Health upon a showing satisfactory to the Director of Public Health of a violation by the holder of such operator's card of any rule of the Director of Public Health or provision of this chapter or of State law or upon a satisfactory showing that the operator does not possess sufficient skill or that he is negligent and has been responsible for the communication of infections.

Sec. 6-6.07. - Suspension or revocation of operators' permits.

The suspension or revocation of a permit for an operator's card shall automatically suspend or revoke any license issued to such person under the provisions of this or any other law of the County. Upon making any order of suspension or revocation, the Director of Public Health shall notify in writing the Tax Collector and Treasurer and the Sheriff-Coroner.

Sec. 6-6.08. - Expiration date of permits.

A permit for a tattooing establishment or an operator's card under the provisions of this chapter may be granted at any time during the year, but all permits and operator's cards issued pursuant to this chapter shall expire on the thirtieth (30th) day of the next succeeding June. Such permit or operator's card shall not be transferable.

Sec. 6-6.09. - Tattooing regulations.

The Department of Public Health is hereby authorized to establish and maintain appropriate regulations for the conduct of tattooing within the County.

Sec. 6-6.10. - Violations: Penalties.

Any person, firm, or corporation who shall violate any of the provisions of this chapter or fail to comply with any order or regulation made pursuant to this chapter shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not less than Fifty and no/100ths ($50.00) Dollars or more than Five Hundred and no/100ths ($500.00) Dollars, or by imprisonment in the County Jail for a period of not less than ten (10) days or more than six (6) months, or by both such fine and imprisonment.
