Sec. 6-2.01. - Registration.

It shall be unlawful for any person to carry on or engage in the business of cleaning sewage disposal systems or to dispose of the cleanings therefrom unless he shall hold an unrevoked certificate of registration issued by the Health Department.

Sec. 6-2.02. - Employee responsibility.

It shall be unlawful for any person to clean sewage disposal systems or to dispose or aid in the disposal of the cleanings therefrom for any person or firm engaged in the business of cleaning sewage disposal systems or the disposing of the cleanings thereof who does not hold an unrevoked certificate of registration as provided in this chapter

Sec. 6-2.03. - Private domestic sewage disposal systems.

It shall be unlawful for any person to clean a sewage disposal system or to transport the cleanings thereof by way of any County road without first obtaining permission and instructions from the Health Department.

Sec. 6-2.05. - Registration requirements.

Applicants may be registered under such terms, orders, conditions and directions as the Health Department may deem necessary for the protection of human health or comfort. Each applicant for registration shall show to the satisfaction of the Health Department by written or oral examination, or both, that he has an adequate knowledge of sanitary principles and of the laws and ordinances affecting human health or nuisances. Such examination shall be taken only once at the time of first registration under this chapter and shall not be retaken unless a certificate of registration shall be allowed to lapse. No applicant for registration shall be registered to clean sewage disposal systems who has ever been known to have violated any sanitary law, ordinance or direction while operating as such cleaner in any city, county or state. No applicant for registration shall be registered who has ever been known to have allowed his laborers or employees to perform their duties in a manner which endangered human health or comfort. The Health Department shall be required to act upon each application within twenty-one (21) days of the date of filing the same.

Sec. 6-2.05. - Registration application forms.

The Health Department shall provide an application form setting the information and data required by such department as a prerequisite to the issuance of a certificate of registration. One copy of each application taken shall be furnished to the Sheriff, and he shall have the authority to make any inspection of equipment or procedure he may deem necessary to enforce compliance with the provisions of this chapter

Sec. 6-2.06. - Registration fee.

The Health Department shall issue a certificate of registration to each approved applicant. The certificate shall be only for the unexpired portion of the calendar year in which application is made, and at the end of the calendar year all certificates shall become void and of no effect. The required registration fee shall be listed in Table 5-7.01 of Chapter 7 of Title 5 of this Code regarding fees for public health services. Such certificate shall not be transferable and shall be in possession of its legal owner at all times while in the process of cleaning any sewage disposal system or transporting or disposing of the cleanings thereof

Sec. 6-2.07. - Equipment requirements.

Each approved vehicle and its operator shall be registered by the Health Department and assigned a registration number which shall be identical with the number of the certificate of registration. Each vehicle and piece of equipment which is to be used for the purpose of cleaning sewage disposal systems shall be inspected and approved or disapproved by the Health Department, and only such vehicles as are approved and listed on the certificate of registration shall be used for such purposes. The tank capacity of the vehicle and the name and address of the person operating such service shall be displayed on both sides of the vehicle and shall be of such size, shape and color as to be readily legible during daylight hours from a distance of fifty (50') feet. Any misrepresentation of the above mentioned display or unauthorized fixation to any vehicle shall constitute a misdemeanor. The tank capacity of the vehicle shall not be less than 500 gallons. Those persons presently registered in the County shall have until November 9, 1963, in which to comply with the tank capacity requirement. The equipment used in the process of cleaning sewage disposal systems shall function so as to prevent any possible leakage of the contents therefrom.

Sec. 6-2.08. - Manner of disposal.

The process of cleaning sewage disposal systems and the transporting of the cleanings shall be done in such manner that it will not result in:

(a) Contamination of ground water, surface water, soil or streets;

(b) The accessibility of such cleanings to flies or other animals;

(c) Noxious odors or unsightly conditions; or

(d) A nuisance or health hazard in any way.

The disposal of such cleanings shall be done in such manner and place that they will not create a nuisance or health hazard and will not seep, flow or otherwise drain into any river, stream, lake, street, reservoir, road or other drainage facility.

Sec. 6-2.09. - Reports to Health Department.

Each person registered pursuant to the provisions of this chapter shall file with the Health Department a weekly report which shall contain a statement giving the name and address of the owner or tenant of each and every one of the premises where a sewage disposal system shall have been cleaned by the registrant or his employees, and such statement shall describe in precise terms on forms provided by the Health Department the time and place where the cleanings shall have been disposed of and by whom. The County Health Officer is hereby empowered to require such statements to be sworn to before a notary. A change of address of any registrant, including a member of a partnership which is registered and of the place of business thereof, shall be reported in writing by registered mail within one day after such change of address.

Sec. 6-2.10. - Revocation of registration.

Any registration issued under this chapter may be revoked by the County Health Officer for cause on seven (7) days' notice to the applicant, which notice shall be served by registered mail or in person at the latest place of residence or business reported by the applicant.
