1.12.010 - Violations—Misdemeanors—Infractions—Wobbler.¶
A. No person shall violate any provision, or fail to comply with any of the requirements of this code, including, but not limited to, any code or ordinance adopted in this code by reference. Any person violating any of the provisions or failing to comply with any of the mandatory requirements of this code, shall be guilty of a misdemeanor unless the offense is specifically classified in the code or by state law as an infraction, or the city prosecutor reduces the charge to an infraction in the interests of justice, in which case the person shall be guilty of an infraction.
B. Any person convicted of a misdemeanor for a violation of any provision of this code or, any other ordinance of the city, shall be punished by a fine of not more than one thousand dollars, or by imprisonment in the city or the county jail for a period not exceeding six months, or by both such fine and imprisonment. Each such person shall be guilty of a separate offense for each and every day during which such violation continues.
C. Except as otherwise provided in this code or state law, a violation of an ordinance which is defined to be an infraction is punishable by:
A fine of not more than one hundred dollars for a first violation;
A fine of not more than two hundred dollars for a second violation of the same provision of this code or an ordinance within one year;
A fine of not more than five hundred dollars for each additional violation of the same provision of this code or an ordinance within one year;
A fourth violation of the same provision of this code or an ordinance within one year shall constitute a misdemeanor and shall be punishable as provided in subsection B of this section unless the city prosecutor reduces the charge to an infraction in the interests of justice, in which case the person shall be guilty of an infraction.
